PURPOSE The purpose of this directive is to provide general procedures and guidelines for conducting cr iminal investigations. B. SCOPE This directive is applicable to all sworn members of the Depart ment. C. POLICY 1. Investigations begin upon the first notification that a crime m ay have been committed and ends when the case is solved and the perpetrator is arrested, prosecuted, or the c ase has been otherwise reso lved. It is of critical importance that each aspect of th e investigative process is con ducted properly and that each member participating in the investiga tion understands their responsibi lities and the parameters under which they must operate. Department members will apply proactive investigative methods w hen possible, and investigate reported crimes to the extent necessary to suppor t prosecution or otherwise res olve the case. D. DEFINITIONS Case File: An accumulation of all documents, reports, and information rela ted to a specific crime, excluding items of an evidentiary nature, photocopies of which may be included after the originals are placed in the Property Evidence facility. Custodial: In custody of law enforcement o fficers or otherwise deprived o f freedom of action in any significant way. Interview: Is the method used to obtain information from persons having kn owledge of a particular incident and the willingness to provide it. Interrogation: Express questioning and also any words or actions on the part of a member that the member should know is likely to elicit an incriminating res ponse from the suspect. Non-Custodial: Questioning of a susp ect in a setting where it is clear that t hey have the ability to terminate the quest ioning and leave. Surveillance: The continuous or prolonged observ ation of a targeted individua l, group, or organization by clandestine means to gather information relativ e to an open criminal investigation. Surveillance differs from monitoring in that it typically invol ves the use of more invasive tactics such as electronic monitoring. E. PROCEDURE 1. General: a. The Chief of Police or designee is authorized to designate swor n members to conduct criminal investigations. This designation is an assignment not a promoti on. b. All records relating to vice and organized crime are maintained separately and securely from the central records system. 2. Preliminary Investigation: a. A properly conducted preliminary investigation may be sufficien t to bring a case to a satisfactory conclusion, thereby eliminating the need for follow-up investig ation. A preliminary investigation begins when the first member arrives at the scene of an incident and b egins a criminal investigation. b. The activity should continue until such time as postponement of the investigation or transfer of responsibility will not jeopardize the successful completion of the investigation. Not all steps must be necessarily performed by the first arriving member as some step s may be delegated to other members depending on the complexity of the investigation. City of Sunny Isles Beach Police Department Criminal Investigat ions Unit (CIU) members are not assigned to duty shifts on a 24-hour basis. Therefore, call-out schedules s hall be developed by the C IU supervisor to provide 24-hour on-call availability. a. The CIU supervisor shall be res ponsible for ensuring that an up dated call-out schedule is forwarded to Communications and/or
