PURPOSE To establish guidelines for the appropriate, safe, and dignifie d interactions with transgender individuals by members of the Sunny Isles Beach P olice Department. This policy provides members of the Sunny Isles Beach Police Department with guidelines for the interaction wit h transgender individuals and consists of the following. B. POLICY It is the policy of the Sunny Is les Beach Police Department to treat all individuals with dignity, respect, and professionalism. No person shall be discriminated against based on gender identity, sexual orientation, or any other basis prohibited by local, state, or federal laws. C. DEFINITIONS Transgender Female - A person whose gender at birth was male, b ut identifies and lives as a female. Such persons should be addressed using feminine pronouns (i.e. she, her, and hers). Transgender Identity - A person who utilizes or identifies them selves by gender or persona other than that assigned at birth. Transgender Male - A person whos e gender at birth was female, b ut identifies and lives as a male. Such persons should be addressed using masculine pronouns (i.e. he, him, and his). TvvÉâÇàtu|Ä|àç? tÇw exáÑxvàAÊ D. SCOPE AND APPLICABILITY This directive applies to all members of the Sunny Isles Beach Police Department. E. PROCEDURES 1. Addressing Individuals a. Employees shall address a transgender individual using the pers on’s clearly stated gender identity, including preferred name and appropriate pronouns. Employees wh o are unsure which pronoun is appropriate shall respectfully ask the transgender person which they prefer. b. If a person has not clearly stated their gender identity, but t he person’s intended gender presentation is reasonably clear based on attire and other cues, the individual shall be treated in accordance with their expressed gender. c. If a person’s self-identified or expressed gender is unclear, t he officer should make a determination based on any other available information. Gender information on gover nment-issued identification and other documents may be used as presump tive evidence of gender identit y only in the absence of self-identification by the individual or some other obvious expression of gender id entity. d. Officers shall avoid unnecessary personal questions regarding a n individual’s anatomy or sexual history. 2. Calls For Service All calls for service or complai nts by transgender individuals shall be addressed and inv estigated in accordance with applicable Departmental po licies for any other call for se rvice or complaint. 3. Stop And Frisk a. An officer shall conduct all stop and frisk encounters, field i nterviews, searches, and seizures with or without a warrant in conformance with agency policy (Bias based profiling and Search of person) and controlling state and federal law. b. A stop, frisk, or search shall not be performed for the sole pu rpose of determining an individual’s anatomical gender. Transgender individuals s hall
