A. PURPOSE
The purpose of this directive is to establish disciplinary proc edures to ensure that the Department administers
disciplinary action in a consistent and equitable manner. This procedure shall establish lines of authority and
responsibility for administering discipline.
B. SCOPE
This directive is applicable to all employees of this Departmen t.
C. DEFINITIONS
Corrective Action : Non-punitive, remedial component of the Department's discipl ine system used to correct minor
infractions/violations, and work performance deficiencies. Corr ective actions are not considered punitive, therefore,
are not subject to appeal. Correc tive Actions include remedial training, coaching, and counseling.
Collective Bargaining Unit Member : A employee of a job class for which the collective bargaining association
acts as the exclusive bargaining representative regardless of w hether the employee is a member of the association.

Disciplinary Action : An action initiated by a supervisor when positive corrective measures designed to train or
effect behavior changes are unsuccessful in attaining satisfact ory employee job performance. In addition, action
initiated when an employee commit s a pronounced deviation regar ding a directive, City ordinance, or law.
Grievance: A dispute or difference between employees and administration i nvolving a perceived job related
incident or occurrence, or a dispute involving the interpretati on or application of the collective bargaining
agreement. Cases related to discipline are considered appeals a nd shall be handled in the manner specified in the
collective bargaining agreement or the City of Sunny Isles Beac h Employee Policies and Procedures for Employee
Dispute Resolution, as applicable. The Chief of Police serves a s the grievance coordinator.
Non-Collective Bargaining Unit Member : An employee not covered by a collective bargaining agreement. This
includes the Chief of Police, Command Staff, and civilian emplo yees of the City of Sunny Isles Beach Police
Department. Violations : Supervisors shall cite a specific statute, city and/or Depart ment directive, rule, order, policy, or
procedure when reprimanding an employee or initiating disciplin ary action.
D. PROCEDURES
1. The Department reserves the right to treat each occurrence on a n individual basis without necessarily
establishing a precedent fo r future discipline.
2. All employees of the Department are subject to corrective actio n and discipline under the provision of this
directive.
3. Nothing herein shall supersede th e provisions of a Collective B argaining Agreement. All provisions are subject
to the mandates and constraints imposed by Florida law, includi ng Chapter 112 of the Florida Statutes.
4. When an employee of the Department is found to be in violation of City or Departmental rules or orders, City
of Sunny Isles Beach ordinances, or any other applicable state or federal statute and disciplinary action is
appropriate, the corrective acti on of discipline shall be selec ted from among the following options:
a. Informal Counseling or Coaching- An Informal Counseling or Coac hing is administered in person by a
supervisor to an employee of lesser rank. Informal Counseling o r Coaching shall normally be appropriate
in the case of minor violations that have not been of a recurri ng nature and not placed in the employee’s
police personnel file. The Informal Counseling or Coaching Form shall be retained by the author and a copy
given the employee upon request. Informal C ounseling or Coachin g does not require the employee to sign
the Employee Counseling / Discipline Form.
b. Written Counseling / Warning- A w ritten Counseling / Warning sh all be entered into the employee’s police
personnel file for two (2) years (Based on the State of Florida Schedule of Records GS1-L). The form will
be signed by the employee and the employee’s Chain of Command t o include the Chief of Police. These
