A. PURPOSE
The purpose of this policy is to establish procedures and guide lines for conducting inquiries into complaints against
employees of the Sunny Isles Beach Police Department and to inf orm all Department employees of the procedures
for addressing complaints of misconduct.
B. SCOPE
This policy applies to all employees, volunteers and interns of the Sunny Isles Beach Police Department.
C. POLICY
It is the policy of the Sunny Isles Beach Police Department to investigate all complaints of alleged misconduct by
Department employees and to do so in accordance with federal, s tate and local laws; the exi sting labor agreement; and
applicable City and Department po licies and procedures. Members of the Department shall assist and cooperate in the
expeditious and impartial processi ng of complaints consistent w ith established procedures.
It is also important that the appropriate disciplinary action b e initiated against any employee who breaches these
standards. It is equally important that all employees be protec ted against inaccurate and false allegations of impropriety.

Complaint - Any alleged act by a member which is contrary to written rule s, regulations, policies, procedures,
laws, directives, or orders of the agency, an alleged act or om ission which, if substantia ted, would constitute a
violation of the law or any allegation which indicates an actua l or potential defect in Department rules, regulations,
policies, procedures, directives, o rders or the delivery of ser vices.
Internal Administrative Investigation - A comprehensive investigation, gathering and securing eviden ce and facts
to discover truth and reach conclusions as to whether a Departm ent member has violated any rules, regulations,
policies, and/or procedures of the agency. Supervisory Inquiry - A preliminary review undertaken immediately upon receipt of a complaint. Conducted for
the thorough gathering, collection and review of evidence and f acts to discover truth and reach conclusions as to
the possibility a department member has violated any rules, reg ulations, policies and/or procedures. The fact-finding
supervisor will make contact with the complainant in order to d iscuss the incident and will notify the complainant
of the final outcome of the re view, with the approval of the Ch ief of Police, or designee.

E. SOURCES OF COMPLAINTS
1. Complaints, regardless of category, may be lodged with any memb er of the Department.
2. Complaints shall be accepted in w riting, in person, electronica lly or by telephone. Any supervisor or member
receiving a complaint on a Department member shall immediately forward it to the Chief of Police, or designee.
3. All complaints shall be documen ted on form Annex 20A, Complaint Form whether by a citizen submitting the
complaint or by a member or supervisor receiving the
