A. PURPOSE
The purpose of this order is to establish guidelines for the us e of personal electronic devices used by members to
collect, preserve or disseminate digital images, video and audi o files while on-du ty or representing the Department
in any way. This order is not intended to supersede, undo, or a mend written policy defined elsewhere in department
general orders which govern the use of electronic devices owned , issued or approved for u se by the Department.
B. SCOPE
This general order is applicable to all members of the Sunny Is les Beach Police Department regardless of title,
assignment or rank
C. POLICY
1. The Department recognizes that t he proper collec tion and handli ng of digital images, video and audio files are
essential practices associated with information gathering, evid ence collection, criminal investigations, police
training and the overall delivery of law enforcement services.
2. The Department further recognizes that members are often privy to situations and events not otherwise available
to the public and that such situations and events may establish a reasonable expectation of privacy for those
present.

3. The Department also recognizes that members often have personal cameras, cellular telephones, and other
electronic devices readily available while on-duty or represent ing the Department that are capable of recording
digital images, video and audio files and that the use of such devices in these circumstances must be governed
by department policy.
D. DEFINITIONS
Department- The City of Sunny Isles Beach Florida Police Department
Department Member- Any sworn or civilian member, employee, contractor, or voluntee r of the Sunny Isles Beach
Police Department
Digital recording - For the purpose of this order, digital recordings shall incl ude digital images, videos and audio
files.
Electronic device - For the purpose of this order, electronic devices shall inclu de cameras, cellular telephones, and
other devices capable of recordi ng, storing or transmitting dig ital images, videos and audio files.
E. PROCEDURES
1. Whenever collecting or handling digital recordings, while on-du ty or representing the Department, members
shall comply with the following regulations:
a. All members shall, in the absence of exigency, refrain from usi ng personal electronic devices to collect
digital recordings for any purpose including evidentiary purpos es.
b. The preferred practice for collec ting digital recordings for ev identiary purposes and other bona fide
department purposes is to use an electronic device issued or ap proved by the Department.
c. Whenever the need to collect digital recordings arise and a dep artment issued or approved electronic device
is not immediately available, members shall, when practicable, request the assistance of other on-duty
personnel who possess a department issued or approved electroni c device.
