PURPOSE The purpose of this policy is to establish guidelines for the u se of the Florida Division of Highway Safety and Motor Vehicles’ (DHSMV) Driver and Vehicle Information Data Base (DAV ID). B. POLICY The DAVID system provides important personal information, vehic le information and photographs useful for criminal investigations and other law enforcement purposes. It is the policy of Sunny Isl es Beach Police Department that this system is used in acco rdance with all applicable Stat e and Federal laws and DHSMV policies regarding use of the system, and protection of the privacy of the informa tion contained within the system. C. DEFINITIONS Department -The Sunny Isles Beach Police Department. Digital Certificate - A computer data file used to validate a u ser’s access to prevent unauthorized access. The file uses an exchange of encrypted data to gain access. Driver’s Privacy Protection Act (DPPA) - United States Code reg ulating the use of driver’s license information. (18 United States Code section 2721 et seq.) Florida Criminal Justice Network - A limited-access website ope rated by the Florida Department of Law Enforcement that provides various resources and database access to criminal justice agencies. (http://www.flcjn.net) Florida Department of Highway Safety and Motor Vehicles (DHSMV) - State agency responsible for computerized driver’s license, vehicle, and traffic crash records. For purpo ses of this general order, FDHSMV is the “provider agency” for DAVID information. Highly Restricted Personal Information - An individual’s photog raph or image, social security number, medical or disability information. (DAVID MOU definition.) Local David System Administrator - Individual or employee desig nated by the Chief of Police to manage and supervise the DAVID system at th e agency level. This position m ay also be referred to as the “point-of-contact” in the DAVID system. Member - Any employee of the Sunny Isles Beach Police Departmen t including contract employees. Memorandum of Understanding (MOU) - Agreement with Sunny Isles Beach Police Department and DHSMV. Personal Information - Informati on found in the motor vehicle o r driver record which includes, but is not limited to, the subject’s driver identification number, name, address, telephone number, and medical or disability information. Personal informa tion does not include information related to vehicular crashes, driving violations and driver’s status. (18 USC S.2721 definition.) Point of Contact (POC) - The Department individual designated t he responsibility of ensuring internal access/control of authorized users, maintaining liaison with DH SMV, and auditing lists of current users against reports from DHSMV. This person may also be known as the Local System Administrator. D. SCOPE AND APPLICABILITY This policy applies to all members of the Sunny Isles Beach Pol ice Department. E. ACCESS 1. Access to DAVID shall be availabl e upon request to Department p ersonnel who need access to the system to perform job functions. 2. Access shall be provided via an internet connection to specific computers with appropriate software (digital certificates or other secure methods as specified by DHSMV) tha t will protect access from unauthorized persons. 3. DAVID SHALL NOT BE ACCESSED BY ANY PERSONAL DEVICE NOT AUTHORIZ ED BY THE DEPARTMENT . (E.g. Smartphones, personal tablets, computers, etc.) DAVID DATABASE General Order
