Published with permission by Santa Clara County Sheriff's Office Crowding - 1 Santa Clara County Sheriff's Office Custody Manual Crowding 1103.1 PURPOSE AND SCOPE One of the determining factors in maintaining a safe and secure jail is to limit the incarcerated person population to the number of beds constructed in each incarcerated person classification level. Occasionally, emergencies occur that will require the Santa Clara County Sheriff's Office to exceed its approved bed capacity within the jails. This policy establishes the approved bed capa city of the jail, addresses temporary population excess, and provides a plan for gathering statistics and projecting long -term space needs. 1103.2 POLICY It is the policy of the Sheriff’s Office to manage the incarcerated person population to the extent reasonably possible to avoid exceeding the approved bed capacity within the jails. 1103.3 RESPONSIBILITIES The Sheriff or the authorized designee is responsible for ensuring that the jails have a sufficient number of housing units in an appropriate configuration so that incarcerated persons can be separated according to the classification plan. In the event of an emergency that causes the jails to be populated beyond the approved bed capacity, every reasonable effort should be made to reduce the incarcerated person population to the approved bed capacity as soon as reasonably practicable. The She riff’s Office will take affirmative action to address excess population. If the incarcerated person population remains over capacity or continues to increase, a committee should be formed to examine any and all methods to ensure that the jail populations a re reduced and remain within the approved bed capacity. When the incarcerated person population nears the approved bed capacity of the jails, the committee should meet to identify potential solutions to reduce the population to, or below, the approved bed capacity.
