Smoking and Tobacc o Use
1101.1 PURPOSE AND SCOPE
This policy establishes limitations on the use of tobacco products while in and around Santa Clara
County Office of the Sheriff facilities or vehicles.
For the purposes of this policy, smoking and tobacco use includes but is not limited to any tobacco
products, such as cigarettes, cigars, pipe tobacco, snuff, tobacco pouches, and chewing tobacco,
as well as any electronic smoking device such as an electronic cigarette or personal vaporizer.
1101.2 POLICY
It is the poli cy of the Sheriff's Office to maintai n complian ce with County policy, ordinances, state
laws, an d regulatio ns relating to tobacco use. The Sheriff's Office prohibit s smoking an d tobacco
use by staff, incarcerate d persons, and visitors i n all Sheriff's Office faciliti es, buildings, and
vehicl es, and a s further outlined in thi s policy.
This poli cy adheres t o the Santa Cl ara Count y Boar d of Supervisors ’ No Smoking Policy. This
policy will not be less restrictive than the County Board Policy.
1101.3 SMOKING AND TOBACCO USE
It shall be the responsibility of each staff member to ensure that no person under their supervision
smokes or uses an y tobacco product inside Count y of Santa Cl ara facilities and vehicles.
1101.4 ADDITIONAL PROHIBITIONS
Smoking and use of other tobacco products i s not permitted inside Sheriff' s Office facilities,
Sheriff's Office vehicles, or any other County of Santa Clara building (Labor Code § 6404.5).
No person shall smoke tobacco products within 30 feet of an entrance, exit or operable window
of any public building, including any Sheriff's Office facility. (Government Code § 7596 et seq.).
1101.4.1 NOTICE
The Division Commander or the authorized designee should ensure that proper signage regarding
smoking and tobac co us e prohibitions is posted at each entrance of all Sheriff's Offi ce facilities
(Labor Code § 6404.5).
1101.5 POLICY REVIEW
This poli cy shall be reviewed at least once ever y two years.
