Published with permission by Santa Ana Police Department***DRAFT*** Electronic Devices - 1Electronic Devices 233.1 PURPOSE AND SCOPE To enhance the safety and security of the Santa Ana Jail and to align with California state law by prohibiting the unauthorized possession of wireless communication devices. Penal Code Section 4575(a) provides: "Any person in a local correctional facility who possesses a wireless communication device, including but not limited to, a cellular telephone, pager, or wireless Internet device, who is not authorized to possess that item is guilty of a misdemeanor, punishable by a fine of not more than one thousand dollars ($1,000)." Although the range of devices prohibited by this policy include, but are broader than, the wireless communication devices prohibited by Section 4575(a), it is important to note that the violation of this Penal Code Section is a misdemeanor, punishable by a fine of not more than $1,000. 233.2 ELECTRONIC DEVICE PROTOCOL This policy applies to any person, including all Department personnel, medical/mental health staff, maintenance staff, support staff, contract staff, volunteers, official visitors, and vendors, while inside the secure area of the facility. 233.3 ELECTRONIC DEVICE DEFINITION The use or possession of cellular telephones, cellular watches, and personal electronic devices within the secured area of a jail facility or detention area is prohibited unless specifically authorized as provided in Section 233.4. All persons entering the secured area of a jail facility shall be required to secure their cellular phone and/or electronic device in a location outside security. Electronic devices include, but are not limited to: (a)Cell phones (b)Personal Digital Assistants (PDA) (c)Televisions (d)Laptops or any other type of computer (e)Physical media players of any kind (CD, DVD, VHS, etc.) (f)Digital media players of any kind (g)Electronic digital book readers (h)Any other computing or video gaming devices (i)Any device that provides and/or requires a connection to the internet 233.4 AUTHORIZATION EXCEPTION The following personnel may authorize persons to retain a cellular phone or other electronic device(s) in furtherance of an official duty or in the event of an emergency: Santa Ana Police Department Custody Manual Electronic Devices Copyright Lexipol, LLC 2025/05/23, All Rights Reserved. Requests for ongoing authorization must be submitted in writing, detailing the necessity for the device and specifying the relevant dates where authorization is requested. These written requests will be reviewed by the Jail Administrator.
