Published with permission by Santa Ana Police DepartmentLOUD AND RAUCOUS NOISE PROCEDURES - 1LOUD AND RAUCOUS NOISE PROCEDURES 10407.1 PURPOSE These procedures apply to the police response to, and the handling of, loud and raucous noise complaints. 10407.2 BACKGROUND Responding to complaints of large parties/gatherings and loud and raucous noise/music requires a significant amount of field resources on a daily basis. Officers respond to thousands of loud music and party calls, making these calls one of the highest demands for police services. Traditionally, the Department's response to large parties and music has been to issue warnings to first-time offenders and request compliance by lowering the noise levels. This practice results in limited success, and frequently, second and third complaints are received within hours, requiring the response of numerous officers to address the problem. 10407.3 POLICY It is the policy of the Santa Ana Police Department to enforce applicable laws when responding to loud and raucous noise complaints. 10407.4 PROCEDURES 10407.4.1 APPLICABLE LAWS AND CODES •CPC 148(a)(1) – Resisting/Delaying an Officer •CPC 415(2) – Disturbing the Peace (misdemeanor) •CPC 416(a) – Failure to Disperse (misdemeanor) •SAMC 10-153 – Loud and Raucous Noise •SAMC 21-6 – Business License Required (Used for DJs or live musicians who are paid by the host) •CVC 27007 – Loud music heard from a moving vehicle, 50 feet or more away •SAMC Sections 10-300 through 10-305 – Process for reimbursement of police services 10407.4.2 POLICE FIRST RESPONSE Officers have a variety of options when handling loud and raucous noise complaints and calls. On the first visit to an offending location, officers have discretion, but are strongly encouraged, to complete an administrative citation via their patrol vehicle computer. An administrative citation will be completed and mailed to the responsible person (as defined in SAMC §10-153(C)) by Field Operations Bureau personnel, at a later time. Accurate recording of the call information into the RMS system is vital. If the call location is an apartment, mobile home, or intersection, the exact address, to include apartment number or inside address, must be amended via your MDC or given to Dispatch. 10407.4.3 SECOND AND SUBSEQUENT RESPONSES When dispatched to a location regarding loud and raucous noise or a loud party complaint for a second or subsequent time, the handling officer is strongly encouraged to consider the option of either completing an additional administrative citation (via your MDC), making a physical arrest (CPC 415), or issuing a criminal citation (SAMC 10-153). 10407.5 SUMMARY Proactively enforcing appropriate laws and codes is the Department’s effort to reduce the high volume of calls for police service to address these complaints. Sworn officers and supervisors should familiarize themselves with this process and use it whenever appropriate.
