8022.1 PURPOSE
These guidelines shall be used to explain the requirements and procedures for entering a gun that
has been defined as a “crime gun” into the CLETS Automated Firearms System (see Attachment
1 in section 8022.7) and the Firearms Supplemental Property Report (see Attachment 2 in section
8022.8.)
8022.2 INTRODUCTION
Prior to 2002, most firearms were entered into the Automated Firearms System for one of several
reasons. Effective January 1st, 2002, three additional reasons required local law enforcement
agencies to enter firearms into AFS: the recovery of firearms which have been used in a crime,
suspected of being used in a crime or illegally possessed. A firearm matching any one of these
three criteria is defined as a “crime gun.” Per California Penal Code (PC) Section 11108.3, this
information will be electronically forwarded to the National Tracing Center of the Federal Bureau
of Alcohol, Tobacco and Firearms to aid in the identification and tracing of these firearms.
8022.3 CRITERIA
Any gun that has been used in a crime, is suspected of being used in a crime, or is illegally
possessed must be entered into AFS and the Firearms Supplemental Property Report shall be
completed. Often times, firearms obtained by officers during an investigation will fall into this
category. Firearms booked for safekeeping do not fall under this requirement. A stolen gun used
and then left by the suspect at the scene of a crime would be entered as a crime gun, a “Locate”
and as “Evidence.” Both forms shall be used for all entries relating to that firearm. Any found
firearm will be classified as a crime gun.
8022.4 REQUIRED INFORMATION
With AFS there are nine fields which must be used to enter a crime gun, in addition to the twelve
fields used to describe the firearm. The name, DOB, and OLN# of the possessor are optional
fields used when the suspect is known. When the possessor is unknown, such as when the gun
is found at the scene of a crime, the fields may be left blank. If the possessor is later identified,
records personnel may modify the AFS record to reflect this new information.
Additionally, the officer will complete the Firearms Supplemental Property Report (pursuant to
California AB 2001 and CPC 11108.3, see Attachment 2) and attach it to the crime report. The
Firearms Supplemental Property Report consists of 32 fields of information in three sections to
include: The Firearm Description Section, and Possessor/Associate Information, and finally, the
Firearm Recovery Location Information fields will be completed if known.
Crime Gun - A crime gun is any recovered firearm which has been used in a crime, suspected of
being used in a crime, or is illegally possessed.
