1Mandatory Overtime for Correctional Officers
203.1 MANDATORY OVERTIME FOR CORRECTIONAL OFFICERS
In compliance with the Fair Labor Standards Act (FLSA), mandatory overtime (MOT) shall be
limited to a maximum of 3.5 hours per shift, occurring either immediately before or immediately
after an officer's normally scheduled work hours.
Minimum staffing is based on the current conditions to ensure the safe and effective operation of
the Jail. Adjustments will be made according to the specific needs and circumstances of each shift.
A.Officer safety combined with jail operations are the primary considerations for
maintaining appropriate staffing levels and mandating overtime.
1.The number of officers needed for mandatory overtime shall be determined by
the Shift Supervisor.
2.Conditions affecting the number of officers required include, but are not limited
to:
(a)Mass bookings, major facility maintenance issues, or module disturbances
may require the supervisor retain staff for mandatory overtime, irrespective
of minimum staffing levels.
(b)The operational feasibility of locking down housing units.
B.MOT may be utilized when the affected shift is below minimum staffing levels or if an
ordered transport detail (i.e. hospital guard or court run) is required. It does not apply
to pre-scheduled transportation assignments.
C.Pre-scheduled overtime shifts/transports will not be canceled in order to accommodate
MOT.
D.Officers must work a minimum of two hours to receive credit for MOT.
E.Officers will not be required to work more than one (1) MOT shift per week unless an
emergency situation arises affecting jail operations. In the event that additional MOT
is necessary, the Correctional Supervisor will inform the Correctional Manager and
Jail Administrator of the need to mandate officers more than once per week.
F.Jail Transportation Officers (JTOs) assigned to an MOT transportation detail of under
3.5 hours may be assigned to other shift duties for the balance of the MOT period, as
needed and at the discretion of the Shift Supervisor.
G.JTOs assigned to an MOT transportation detail of less than 2 hours shall be given the
opportunity to remain on duty to assist the affected shift until the 2-hour MOT minimum
duration is reached.
H.MOT Rotation List:
1.Each shift will maintain a mandatory overtime list. The list should be distributed
to officers daily and should be readily available for review.
2.MOT shall be rotated based on the last date of the MOT assignment, with the
oldest date being at the top of the list.

2(a)Example: If Correctional Officer A was last assigned MOT one day ago
and Correctional Officer B was last assigned mandatory OT five days
ago, Correctional Officer B would be at the top of the list, followed by
Correctional Officer A.
3.For each shift, the three officers at the top of the rotation shall be notified of their
status as soon as is practicable. Those three officers will not be authorized to
leave early unless a time-off request was submitted and approved prior to that
day.
4.When the actual need for MOT is confirmed, the affected officers will be notified
as soon as is practicable.
5.When MOT is needed, the first three officers on the mandatory list will be given
the opportunity to work before the assignment is offered to other officers on the
team.
(a)Example: One MOT assignment is needed. The officer at the top of the
list is assigned but desires to defer their MOT for another day. That officer
is required to ask the officers in the #2 and #3 spots if they would like the
MOT assignment before asking other officers on the team. If the #2 and
#3 officers both decline, any other officer on the team may be asked if they
wish to take the MOT assignment.
(b)This format shall be followed regardless of how many MOT assignments
are needed on a particular shift. If four MOT assignments are made, then
the officers in the next two spots (#5 and #6) shall be asked to act as
substitutes before the remainder of the team is asked.
6.When an officer works an MOT assignment, as the assigned officer or as a
substitute, their name shall be rotated to the end of the MOT list. Officers
volunteering for a MOT shift will have their names moved to the bottom of the
list only once per week.
7.An officer may only defer MOT assignments through one cycle of their team's
MOT list. The use of substitutes is not intended to indefinitely postpone
one's MOT, but to provide an occasional alternative in instances of personal
scheduling conflicts.
