Published with permission by San Luis Obispo Police DepartmentMobile Identification Technology and Devices - 1Mobile Identification Technology and Devices 418.1 PURPOSE AND SCOPE The purpose of this policy is to establish guidelines for the appropriate use of mobile identification technology in identifying a properly detained individual and the management of those devices. 418.2 DEFINITIONS Occurs when an officer intentionally, through words, actions, or physical force causes an individual to reasonably believe he/she is being required to restrict his/her movement. Detentions also occur when an officer actually restrains a person’s freedom of movement. Mobile ID Equipment – Equipment designed to aid law enforcement personnel in the identification of persons through the evaluation of fingerprints. 418.3 MOBILE ID TECHNOLOGY AND DEVICES: TRAINING Only those officers who have successfully completed CAL-ID approved training in the use of mobile identification technology and have read and signed the Appropriate Use form shall be authorized to operate mobile identification equipment and have access to the CAL-ID AFIS database. 418.4 FINGERPRINT SEARCH PROTOCOL (a)Only personnel trained in the use of mobile identification equipment shall be authorized to access mobile identification equipment and data. (b)Policy 811 Criminal Offender Record Information (CORI).Lexipol Policy 321 Search and Seizure and LexipolThe mobile ID search and response is considered Criminal Offender Record Information (CORI); Therefore, all CORI rules regarding access and dissemination of data apply. San Luis Obispo Police Department employees will comply with both (c)Mobile ID devices shall be used only in circumstances in which an officer has a legal right/need to request identification from a subject. (d)The identification information provided by the use of mobile ID technology is considered to be supplemental information and shall be used to compare, evaluate, and/or corroborate information obtained through other investigative methods. Mobile ID technology shall not be used as the sole criteria for confirming a person’s identity. (e)Mobile ID data is only an aid to the identification of a person. Information received from a mobile ID system shall not be used as the sole grounds for establishing probable cause for arrest. Officers and others operating mobile identification equipment or accessing mobile identification data shall ensure the 4th amendment rights of the party being testes is not violated and all local policies and procedures are followed. Published with permission by San Luis Obispo Police DepartmentMobile Identification Technology and Devices - 2418.5 MOBILE ID DEVICE MANAGEMENT The mobile ID devices will be stored in each of the patrol Sergeant’s vehicles and made available to officers at their request as the necessary support equipment is only housed in the Field Supervisor’s vehicles. However, the Supervisor is not responsible for the actual use of the device if the officer making the request is an authorized user of the mobile identification equipment. The San Luis Obispo County Sheriff’s Office Cal-ID shall be responsible for the maintenance and repair of the mobile identification devices and the updating of necessary software.
