Roll Call Training Bulletin Produced by: Mike Hight, PSU. Prepared by: Captain LaCosse, OOI Rick Braziel, Chief of Police Volume 17 June 24, 2011 Found Bicycle Procedures The following changes will be effective as of June 25th, 2011 . The Evidence and Property Section (EPS) w ill no longer pick up and book found bicycles. If a citizen reports an abandoned or found bicycl e, the following procedures will be followed: 1. The Communications Center staff will ask callers who are reporting found bicycles if there are visible serial numbers or an owner applied number (OAN). 2. If there is an OAN, an officer will be dispatched to retrieve the bike and to attempt to locate the owner via the OAN using routine investig ative techniques and databases. 3. In the absence of an OAN, Communications Center staff will run an automated query to determine if the bike has been reported stolen. a. In the event of a “hit”, Communications Center staff will compare the information on the automated response to the description the caller is giving of the bike to dete rmine if it is the item that was reported stolen (frequently a serial number will come back as a hit but to a different bike). 4. In the absence of an OAN or a stolen property “hit”, the caller will be advi sed that if they wish to turn in the found bicycle, they can take it to EPS (555 Sequoia Pacific Blvd) . Current hours open to the public are Monday-Thursday, 0800-1700, except for City Holidays. 5. Per the CA Civil Code – Found prope rty only needs to be turned in if the value is over $100.00 (see 2080 & 2080.1 below). 6. Found bicycles will be booke d and processed at EPS. 7. The Abandoned Bicycle template (ALL-ABAND BIKE RPT) will be removed from the V-mail but maintained as a text template for possible future use. CALIFORNIA CODES CIVIL CODE SECTION 2080 -2080.10 2080 . Any person who finds a thing lo st is not bound to take charge of it, unless the person is otherwise required to do so by contract or law, but when the pe rson does take charge of it he or she is thenceforward a depositary for the owner, with the rights and obligations of a depositary for hire. Any person or any public or private entity that finds and takes possession of any m oney, goods, things in action, or other personal property, or saves any domestic animal from harm, neglect, drowning, or starvation, shall, within a reasonable time, inform the owner, if known, and make restitution without compensation, excep t a reasonable charge for saving and taking care of the property. Any person who takes possession of a live dome stic animal shall provide for humane treatment of the animal. Roll Call Training Bulletin Produced by: Mike Hight, PSU. Prepared by: Captain LaCosse, OOI Rick Braziel, Chief of Police Volume 17 2080.1 (a) If the owner is unknown or has not claimed the pr operty, the person saving or finding the property shall, if the property is of the value of one hundred dollars ($100) or more, within a reasonable time turn the property over to the police department of the city or city and county, if found therein, or to the sheriff's department of the county if found out side of city limits, and shall make an affidavit, stating when and where he or she found or saved the property, particul arly describing it. If the property was saved, the affidavit shall state: (1) From what and how it was saved. (2) Whether the owner of the property is known to the affiant. (3) That the affiant has not secreted, withhel d, or disposed of any part of the property. (b) The police department or the sher iff's department shall notify the ow ner, if his or her identity is reasonably ascertainable, that it possesses the pr operty and where it may be claimed. The police department or sheriff's department may require paym ent by the owner of a reas onable charge to defray costs of storage and ca re of the property.
