Roll Call Training Bulletin Produced b y: Sergeant Willi am Co nner, PSU Katherine Les ter, Chief of Police Prepared by: Officer Jeff Kuhlmann , PSU Volume 101 New Bail Schedule and Procedures UPDATED 2-25-22 Effective Octo ber 1 , 202 1, bail am ounts can inc rease for arrests depending on a defenda nt’s prior record or status of superv ision. For instance, i f a defenda nt has a prior stri ke conviction and /or is on parole, probation o r supervision, their ba il can be enhanced. Therefore, o fficers will need to check an arrestee’s record and status of su pervision . Proc edure : 1. Officers shall run a defendant’s CII number prior to bo oking th e defendant on all felony arres ts. Officers may not rely exclu sively on KPF, because KPF is unlikely to sh ow a defendant ’s entire criminal history. 2. When offic ers make an arrest , they shall confirm that an arrestee has not been released on $0 bail or O.R. for another crime (see “Bail for arrestees with status ” #2). 3. Officers shall write down any strike convictio ns or cur rent status of supervision (parole, probation, etc.) in the PC Declaration in the booking packet. Bail amounts based o n the defendant’s prior record : 1. Bail for any cu rrent fel ony offe nse in which an arrestee has one prior serious or violent felony conviction (STRIKE ), will be set at $500, 000. a. Example: A subject commits a VC 10851, which has $0 bail per the bail schedule, BUT you se e that he has a prior STRIKE convic tion for rape, a serious /violent felony, therefore, bail should be set at $500,000 for the new violation . 2. Bail for any current felony offense in which an arrestee has two prior serious or violent felony conv ictions is $1 million. a. Exampl e: A subject commits a V C 10851, which has $0 bail per the bai l schedule, BUT you see that he has 2 prior convictions for rape, a serious /violent felony, therefore, bail shou ld be set at $1 million on the new violation . 3. Bail for a ny current offense that is a serious or v iolent fe lony, when an arrestee has a prior serious or viole nt felony conviction, i s $1 million. a. Example: A subject commits a 211 PC (STRIKE) and has a prio r 459 PC (first degree) (STRIKE), therefore, bail should be set at $1 million on the new violatio n. 1 4. Bail f or a new offense or viol ation of p robation while an arrestee has te n (10) or more documented arrests, citations, and/or bench war rants with in the preceding twelve (12) month period for any felony or mi sdemeanor is $1 0,000. Bail for a subject on felony probation, parole, or any oth er type of felo ny super vision, will be set on the underl ying supervision case , or the new offense if it triggers a higher bail . a. Example: A subject violates a con dition of felony probation that th ey sta y away fro m a victim’s place of work in a stalking c ase, and the subject is already on probation for, stalking . The refore, the bail amount for PC 646.9(a) – Stalki ng is $50,000, so bail w ill be set at $50,000. 2. Bail for a subject who commits a new of fense or viola tion of proba tion w hile out on O.R ., $0 bail, or who was released with conditions , bail or bon d, is $10,000. a. Example: A subject commits a VC 10851, which has $0 b ail per the bail schedule, BUT has been rel eased on $0 bail for ano ther VC 1 0851. Therefore , the bail amou nt should be set at $10,0 00. 3. Bail for an arrestee who is on pre -trial release or violates terms of pre -trial release, is $10,000. Felonies that are Strikes (Note: t he list provided below is not exhaustive. Please see PC 667.5 and 1192.7 (c) for a co mplete list ): Violent Felonies (PC 6 67.5) 1. Murder (at tempted murder) or voluntary manslaughter 2. Mayhem 3. Rape / Sodomy / 288 (a) or (b) 4. Robbery / Carjacking 5. Arson 6. Felony wit h GBI or 12022.
