FUGITIVES

PURPOSE
The purpose of this order is to establish procedures for investigation, arrest, and transportation of
wanted fugitives.
POLICY
It shall be the policy of the Sacramento Police Department that the apprehension of fugitive felons
from other jurisdictions be considered a priority matter and that the Department cooperate with
representatives of other jurisdictions regarding the disse mination of information, the completion of
requested investigations, and the arrest and transportation of wanted fugitives in accordance with
statutory requirements.
PROCEDURE
A. DEFINITION
FUGITIVE – A subject wanted on criminal charges who has fled the jur isdiction of a law
enforcement agency.
B. RESPONSIBILITIES
1. The Office of Investigations (OOI) Warrants Unit shall
a. Be responsible for all fugitive investigations and extradition processes.
b. Notify the appropriate investigative unit when a prisoner with a serious felony arrest
warrant is arrested and is to be transported/extradited from another jurisdiction.
c. Transport all fugitives to this jurisdiction from outside agencies.
2. Investigative u nit supervisors with the OOI shall
a. Notify the Warrants Unit immediately when any extradition case is brought to their
attention.
b. In serious felony arrest cases, evaluate the need for an investigator to accompany the
warrant investigator during transportation.
c. Route all information regarding fugitives to the Warrants Unit.
C. ARREST PROCEDURES – FUGITIVE FROM JUSTICE (1551.1 PC)
1. When an individual is arrested as a fugitive based on an out -of-state warrant, the indivi dual
shall be charged with §1551.1 PC. This is a California felony charge and is a fresh probable
cause arrest. It is not a warrant arrest. The out -of-state warrant is the information or evidence
that supplies the probable cause to arrest.
2. The completion o f an offense report is required for all 1551.1 PC arrests. If there are fresh
local charges, the person shall be booked on those charges first with the 1551.1 PC case as
the secondary charge. The facts regarding the 1551.1 PC charge can be detailed in that
report. An additional report is not necessary.
