VICTIM S OF CRIME NOTIFICATION

PURPOSE
The purpose of this order is to establish procedures for informing victims of crime of their rights to
justice and due process under the law.
POLICY
It shall be the policy of the Sacramento Police Department to provide victims of crimes , as defined in
the California Constitution, art. 1, § 28(e) , with written notification of their rights under the Victim’s Bill
of Rights Act of 2008, also known as Marsy’s Law.
PROCEDURE
A. GENERAL
A Marsy’s Law brochure ( SPD 186 ) shall be issued to all victims of crimes , including all injury
accidents involving DUI, vehicular assaults , or fleeing the scene of a crime or accident.
B. RESPONSIBILITY
1. Department employees shall provide an SPD 186 to each victim in the above - mentioned
offense/accident reports.
2. The person taking the report shall present the SPD 186 to the victim, the victim’s relative (s), or
other responsible agent as follows:
a. If the v ictim is alert and cognizant of circumstances surrounding the incident, present the
form to the victim.
b. If the victim is not alert, and/or is transported to a hospital for treatment, present the form
to the victim's representative (s) or leave it in the vic tim's personal effects at the hospital.
c. If the victim is deceased, deliver the SPD 186 to the next of kin. If the whereabouts of the
next of kin are unknown, the officer shall deliver the SPD 186 notification to the coroner's
representative for inclusion i n the victim's personal effects.
d. If the victim files an online report, the Department shall send them an electronic version of
the SPD 186.
3. The SPD 186 shall be delivered without unnecessary delay and the disposition of the
notification shall be documented in the offense/accident report.
