Correctional Services Page 1 of 7 6/18 (REV 5/18) MJ/RCCC OPERATIONS ORDER Confidential Visits The purpose of this Order is to outline the procedures for inma te access to confidential visits and to provide a systemat ic process of appealing the sus pension or modification of any confidential visi ts with prisoners at the Main Jail and the Rio Cosumnes Correctional Center (RCCC) in accordance with the Calif ornia Code of Regulations, Title 15, Article 6, Section 1068. I. Policy Confidential visits shall be gr anted to those persons who quali fy under the law for such privileges or for those who obt ain permission from the Division Commander or his/her designee. Confidential visits will be conducted in areas that cannot be audibly monitored by other inm ates and custody staff. II. General Information A. At the Main Jail , confidential pass-thr ough and non-pass-through visit booths are located in each housing unit. 1. Confidential pass-through booths are also available in the c ourt holding areas. Confidential visi ts conducted in the Court Hold ing Area shall take place between 0830 hours and 1700 ho urs, Monday through Friday. B. At RCCC , confidential pass-through and non -pass-through visit booths a re located in Booking, the Maximum and Medium Security housing are as and the Sandra Larson Facility (SLF). C. A confidential pass-through booth may be authorized for: 1. Licensed attorneys, law enfor cement personnel or personnel representing a gover nment agency, licensed and authorized priva te investigators, and the Conflic t Criminal Defender’s Panel. Paralegals or interpreters mus t be accompanied by their attorne y to use a pass-through booth. Attorne ys needing interpreter service s must use State Certified or ot herwise qualifie d court approved interpreters. Correctional Services Page 2 of 7 6/18 (REV 5/18) MJ/RCCC 2. Pass-through booth privileges will be granted to the above categories unless the person has had his/her privileges revoked by the division commander. D. Court orders brought in by conf idential visitors directed to the division commander to perform specific functions shall be directed to th e division administration. Court orders wh ich do not require specific act ion by the division commander shall be directed to a sergeant. III. Non-Pass-Through C onfidential Visits A. Non-pass-through attorney boot hs are available for confident ial visits not requiring the visitor to pass doc uments to the inmate. The fol lowing categories are consid ered confidential visi ts qualifying for a non-pass- through booth: 1. Law students/clerks and par alegals acting on behalf of attor neys. If there is a need for documents to be signed or given to the inma te, front counter personnel will deliv er the documents to the inmat e or obtain required signatures. 2. Physicians, surgeons, psychiatrists, or psychologists licens ed to practice in California. 3. An inmate’s public guardian or conservator. 4. Religious representatives who have obtained security clearan ce from Main Jail Administration. 5. Visits for the purpose of r eviewing of video and audio recor dings. 6. Licensed Private Investigat ors acting on behalf of attorneys and/or clients. B. Pro Per inmates may have conf idential non-pass-through visit s with investigators and witnesses unles s otherwise stated in a court order. IV. Registration Process A. Confidential visitors are s ubject to the same rules and regu lations as the public while visiting the facility. 1. All confidential visitors s hall be subject to inspection as necessary to ensure facility security, i ncluding prevention of the introd uction of contraband. Inspections may inc lude a search of the visitor’s person and personal property, as well as passing through a meta l detector. Correctional Services Page 3 of 7 6/18 (REV 5/18) MJ/RCCC 2. All items, legal or related case documents and required appa ratus or equipment in possession of c onfidential visitors shall be inspected prior to ent ry into the facility. B. Registration of confidential vi sits shall occur at the Publi c Counter at the Main Jail and at the Gatehouse at RCCC during the facility’s regular visiting schedule unless prior arrangements have been approved by a facility watch commander. 1. If a confidential visitor r equests to pre-schedule a legal v isit, the visit is only good for the day he/she requests the visit. C. Public Counter or Gatehouse st aff shall verify an acceptable form of identification. Acceptable forms of identification include: 1. Agency Badge and Ident ification Card. 2. State Bar card or other sim ilar documentation that the attor ney is currently licensed to practice in California or another jurisdi ction. a.
