METHOD OF DISPOSAL FOR PROPERTY RELEASED ON A PERMANENT BASIS
The purpose of this order is to s tate the types of permanent re leases or disposals used
by the Property Bureau and descri be the procedures to be follow ed when finalizing each
type of release or disposal. I. General
A. In order to maintain adequate storage space, property will b e disposed of
as soon as all legal requirement s are met. All pertinent sectio ns of federal,
state, and County codes, as we ll as department General Orders t hat
pertain to the release or dispos al of property will be adhered to when
releasing or disposing of property.
B. A release shall never be comp leted until all re lease criteri a has been met
(refer to Operations Order 57/00. 0). At the time of release, th e person
releasing the property will veri fy the release has been authori zed. If in
doubt, the release will not be co mpleted without further invest igation.
C. Whenever the ownership of any p roperty in possession of the Property
Bureau is disputed by tw o or more claimants, such property shal l not be
delivered to any claimant until the Property Bureau supervisor has
conducted a property hearing and made a det ermination as to own ership
(Section 1413b PC).
D. The decision of the Property B ureau supervisor is final. The recourse
available to the claimant is to submit the claim to the courts for review
(Section 1413c PC).
II. Types of Permanent Releases or Disposals
A. To legal owner (Sections 1407 through 1413 PC and Section 20 80.2 Civil

B. To finder (Section 2080.3 Civ il Code): Refer to Operations O rder 58/01.0.
C. Destruction by Property Bur eau: Refer to Operations Orders 5 8/02.0
through 58/08.8.
