Home Detention Denied Applications
The purpose of this Order is to e stablish the process for denie d applications to the
Home Detention Program and the Pretrial Rel ease Supervision Pro gram.
I. Application review
All applications for either p rogram that have been deemed denie d or “denied
pending” will be submitted to t he Program Sergeant for review. The Sergeant will
review the case file and confi rm that the applic ation does not meet program
eligibility criteria.
II. Notifications
A. If an applicant has been dete rmined, based upon the investig ation and/or
recommendation of the Field Inve stigator, to be ineligible, uns uitable or
unacceptable for the electronic monitoring program, the followi ng will
occur:
1. The reason(s) for the denial will be listed by the Sergeant, who will
prepare a denial letter with the specific reason(s) why the app licant
was denied from participation in the program. This letter will
include the applicant’s appeal rights (Appendix A).
2. If the applicant is not pres ent, the Home Detention records clerk will
mail out a copy of the denial le tter to the applicant, specifyi ng the
reasons for the denial wit h a jail turn-in date.
3. The applicant may be taken in to custody at this time if the Sergeant
or Division Commander deems it necessary.
III. Applications Classified “Approved Pending”
A. An application may be categor ized as “Approved Pending” when certain
criteria on the par t of the applicant, or on the part of others involved, must
be completed. This may includ e but not limited to the followin g:
1. Pending the employer’s verification/cooperation
2. The receipt of the probation officer’s report

Work Release-HDP 3. Or, any other necessary paper work deemed significant by the Field
Investigator or Sergeant
Subsequent to classifying any “Ap proved Pending” files, an appr oved (with
stipulation) letter will be sent to the applicant.
VI. Appeal Processes
The applicant may appeal to the Division Commander which must b e in writing
and within five days after receiv ing notification of program de nial. If the applicant
does not request an appeal at this time, the applicant has five (5) days to appeal
from within custody.
