Correctional Services P age 1 of 2 5/05 (REV 7/07) MJ/RCCC CORRECTIONAL SERVICES Pre-Trial Release Program The purpose of this Order is to standardize procedures for the Pre-Trial Services Program as it applies to Correctional Services. I. Policy The Sacramento County Pre-Trial R elease Program will help reduc e jail population by identifying felony arrestees who may be released on his/her Own Recognizance (OR), with minimal risk to the community. II. General A. The Pre-Trial Release Program is administered and operated b y the Sacramento County Superior Cour t District in cooperation with t he Pre- Trial Services Advisory Board. B. The Sacramento County Superior Court District is responsible for setting Pre-Trial release criteria in consultation with the Sacramento County Sheriff’s Department. C. Pre-Trial Services staff is responsible for performing all t he functions necessary to determine the eligibility of an arrestee charged w ith a felony offense for an OR release. III. Criteria for OR Interview or Non-Interview A. Persons arrested for specified offenses qualify for an OR in terview. An OR package is compiled by Pre-Trial Services staff and forwarde d to a judge for consideration for an OR release. 1. Daytime magistrate duties are shared amongst the home court judges. 2. After normal court hours, an on- call judge is responsible fo r reviewing packages. B. Persons arrested for certain specified offenses are intervie wed by Pre- Trial Services for information only and are NOT eligible for an OR. The files for these arrestees are s ubmitted to a Judge during his/h er arraignment. Pre-trial Services staff maintains a complete lis t of offenses that are interviewed fo r information only. Correctional Services P age 2 of 2 5/05 (REV 7/07) MJ/RCCC C. Arrestees charged with certain offenses do not qualify for a n interview for an OR Release. Pre-Trial staff will prepare a package for thes e arrestees only for submission to the Judg e at arraignment. The following offenses are not interviewed: 1. 187 PC - Murder 2. 3056 PC – Parole Hold 3. Commitment Warrants in excess of thirty. 4. Fugitive from Justice Holds a. Pre-Trial Staff shall complete a “Sacramento Superior Court District Pre-Trial Release Program Non-Interview Record” form if the arrestee has not been interviewed. IV. Intake Staff Responsibilities A. Intake staff is responsible f or coordinating with Pre-trial Services staff to ensure the OR interview process i s completed for eligible priso ners. The OR interview process is done a fter a prisoner has completed the fingerprint and photog raph process. B. Once the interview is compl eted, the prisoner will be proces sed accordingly.
