Correctional Services P age 1 of 7 5/03.0 (Rev 3/19) Work Release - HDP Application Process The purpose of this Order is to e stablish a process for partici pants to apply for the Home Detention and Pre-Trial Re lease Supervision Programs. I. General Policies A. Application Availability 1. Applications for the Home D etention and Pre-Trial Release Supervision Programs are ava ilable at the fo llowing three Sacramento County Sheriff’ s Department locations: a. Work Release Facility/Home Detention Office 700 North 5 th Street Sacramento, CA 95814 b. Rio Cosumnes Correctional Center 12500 Bruceville Road Elk Grove, CA 95758 c. Sacramento County Main Jail 651 I. Street Sacramento, CA 95814 B. Sentencing Requirements 1. Home Detention Program Correctional Services P age 2 of 7 5/03.0 (Rev 3/19) Work Release - HDP a. Individuals who have already been sentenced, but given a stay of execution, may apply for the Home Detention Program. These individuals may apply from “In” or “Out” of custody status. b. Any individuals wishing to apply to the Home Detention Program must be sentenced on all criminal charges (Including out of county charges). Exceptions may be made for minor traffic cases. (1) Applications received from individuals who have pending criminal charges will be given a disposition of “denied”. However, they can reapply when their criminal case has been adjudicated. 2. Pre-Trial Release Supervision Program a. Individuals applying for the Pr e-Trial Release Supervision Program must have their case be in “Pre-Trial” status within Sacramento County. Applic ants cannot have a pending case(s) in any other county. C. Program Fees 1. Program fees are determined on a case by case basis after a financial assessment. The fee guidelines are as follows: a. $130.00 application fee. b. $15.00 per day for student s and medically disabled. c. $7.40 per day plu s one hour’s worth of wages if employed. d. $47.00 per day if self-employed. 2. Participants under 21 years o f age shall have the Program fe es waived pursuant to Californi a Penal Code Section 1208.2. D. Submitting Completed Applications 1. Completed applications must be submitted by the applicant, i n person, with the following: a. The application fee. b. Copies of their police, probat ion reports, and a copy of the court sentencing document (i. e., commitment). This will ensure expeditious proce ssing of the application. 2. Incomplete and/or unsigned applications will be returned to the applicant causing a delay in processing. Correctional Services P age 3 of 7 5/03.0 (Rev 3/19) Work Release - HDP 3. Completed applications may be turned in at the Work Release Facility/ Home Detention Office. 4. In-custody applicants may turn in their completed applicatio ns at the Main Jail or the Rio Cos umnes Correctional Center. III. Out of County Commitments A. Commitments from Out of County 1. The Sacramento Sheriff’s Depar tment Home Detention Unit may accept applicants with an “Out-o f-County” commitment under the following conditions: a. There should be a reciprocal agreement on file with the “Outside” County. b. The applicant must comply with the same sentencing requirements, application s ubmission process, and fee requirements outlined abov e for all applicants. c. Applications for either Home Detention or Pre-Trial Release Supervision, from individuals i ncarcerated outside of Sacramento County will not be accepted. B. Additional Requirements 1. The applicant’s out of count y commitment must contain the following information: a. Defendant’s name. b. Criminal charges. c. Sentencing judge’s name and signature. d. Sentencing court’s name and name of originating county. e. Court seal. f. Sentencing date. g. Sentence and conditions o f sentence; e.g., concurrent, consecutive, and/ or credit for time served. h. A statement that the s entence may be served in the Sacramento County Alter native Custody Program. i. Written approval for transfer from transferring county must be submitted. IV. Processing the Application A. Upon receipt of a new application, a Records Officer or Field Investigator will invest igate the following: Correctional Services P age 4 of 7 5/03.0 (Rev 3/19) Work Release - HDP 1. Confirm the applicant has si gned it. If unsigned, it will b e returned to the applicant for signature bef ore beginning the investigati on. 2. Confirm the applicant has no pending charges, warrants, Judg e’s remarks of program denial or hol ds which would preclude the applicant’s participation. 3. Request a copy of the applicant’s probation and/or arrest re port from the applicant or the applicant’s
