Off-Duty Employment
Non-Law Enforcement Related
The purpose of this General Order is to provide the Sacramento County Sheriff’s Office
a policy relative to non-law enforcement related off-duty employment.
I. Scope and Authority
A. This Order applies to all sworn and non -sworn employees of the
Sacramento County Sheriff’s Office .
B. The employee’s division commander shall recommend approval of all off -
duty work. Final approval shall be granted by the Chief Deputy of the
employee’s service area.
II. Eligibility and Restrictions
A. Employees shall be permitted to work up to sixteen (16) hours in any 24 -
hour period, including those hours worked on duty with the Sheriff’s Office .
This restriction will allow those working an 8 -hour shift to work an
additional eight (8) hours off -duty, and those working a 10 -hour shift, an
additional six (6) hours off -duty.
B. The same sixteen (16) hours in any 24 -hour period r estriction shall apply
on the number of hours employees may work on their days off or while on
holiday -in-lieu, CTO or vacation time off.
C. Trainees in a formalized training program (ie: Jail Training Program,
F.T.O., etc.) shall not apply for new secondary employment while their
respective training is ongoing.
D. Sworn employees are prohibited from work ing for ride -sharing companies
(Uber, Lyft, etc.) .
E. Employees are prohibited from knowingly delivering any type of marijuana ,
cannabis, cann abidiol (CBD ), or tetrahydrocannabinol ( THC) product , or
any other substance or product prohibited by state or federal law.
F. Employees are prohibited from delivering alcoholic beverages when they
are the predominant goods being delivered . Employees are prohibited

(Bevmo, Total Wine , liquor stores).
G. Employees authorized to work secondary employment are prohibited
from carrying or utilizing any Sheriff’s Office equipment in that capacity , to
include department issued weapons and home retention vehicles.
H. Sworn employees working non -law enforcement secondary employment
are prohibited from ident ifying themselves as Peace Officers unless
intervening in felony conduct observed in their presence .
I. Employees will not engage in any business or employment which:
1. Is in violation of General Order 9/0 1, Off-Duty Law Enforcement
Involvement, or
2. Involves the use for private gain or advantage of his or her local
agency time, facilities, equipment or supplies; or the badge,
uniform, prestige, or influence of his or her local agency office or
employment, or
3. Involves receipt or acceptance by the e mployee of any money or
other consideration from anyone other than his or her local agency
for the performance of an act which the employee, if not performing
such act, would be required or expected to render in the regular
course or hours of his or her lo cal agency employment or as a part
of his or her duties as a local agency employee, or
4. Involves the performance of an act in other than his or her capacity
as a local agency employee which act may later be subject directly
or indirectly to the control, inspection, review, audit, or enforcement
of any other employee or the agency by which he or she is
employed, or
5. Involves such time demands as would render performance of his or
her duties as a local agency employee less efficient.
J. An employee on Departmental sick leave, convalescent leave (including
4850 leave), limited absence and/or otherwise incapable physically or
mentally of performing their regular full time department assignment, may
work off -duty in a non -law enforcement capacity providing the restrictive
medical condition bears no rela tionship to the off -duty task. For example,
an employee with a disabling back strain is not authorized to work as a
bricklayer, but would be permitted to work as an accountant.
K. Examples of prohibited off-duty activities are as follows, but are not limited
to:

1. Working t he interior or the exterior of a commercial business, bar,
or lounge, whose main source of income is derived from either a
“cover charge” or from the sale of alcoholic beverages. This is to
include outside sidewalks and/or parking lots when the commercial
establishment is permanently licensed by the Alcohol Beverage
Control, and is open to the public and/or is a private club for
members only .
2. Working for either party in a civil or labor dispute invol ving any law
enforcement agency.
3. Working in a c ivil or labor dispute without approval of the Sheriff or
Undersheriff.
4. Working for the defense of any criminal case.
III. Outside Employment
A. The Sheriff’s Office shall not coordinate outside employment except for
uniformed off -duty as outlined in General Order 5/01. However, such
employment is subject to agency approval/disapproval because of the
need to maintain our community’s special trust and to avoid apparen t
improprieties as enumerated in Section II. C. Generally, properly
submitted permission requests for proprietorship interest or off -duty
employment will be approved, providing eligibility criteria are met, and the
