Correctional Services Page 1 of 2 4/14 (New 7/16) MJ/RCCC OPERATIONS ORDER Civil Detainees The purpose of this Operations Or der is to standardize the cond itions of confinement for civil detainees at Sacramento C ounty correctional facilities in a non-punitive manner that are less restrictive than t hose of criminal inmates while considering legitimate correctional interests. I. Policy A. It is the policy of the Sacramento County Sheriff’s Departme nt (SSD) to provide conditions of confinemen t for civil detainees that are non-punitive and less restrictive than those of criminal inmates. B. In setting the conditions of c onfinement for civil detainees , SSD will consider legitimate non-punitive c orrectional interests which m ay include, but are not limited to, ensuring a detainee’s presence at trial , maintaining facility security, and effective management of the facilities. II. Procedures A. Housing - SSD will house civil detainees in separate and sec ure locations from criminal inmates that do no t involve deprivation of privil eges other than what is necessary to p rotect inmates and staff. B. Out-of-Cell Opportunities 1. Subject to legitimate correcti onal interests, SSD will provi de civil detainees with out-of-cell opport unities that are less restrict ive than criminal inmates. a. The out-of-cell opportunities fo r civil detainees will inclu de, but are not necessarily limit ed to, opportunities to watch television, make telephone calls, exercise, and visit with other civil detainees that are less restrictive than the opportunities afforded criminal inmates. 2. Subject to legitimate correcti onal interests, SSD will provi de civil detainees with outdoor recreation opportunities that are less restrictive than the opportunities afforded criminal inmates. Correctional Services Page 2 of 2 4/14 (New 7/16) MJ/RCCC C. Visits 1. SSD will provide civil detainees with three, 90-minute socia l visits per week. 2. SSD will provide legal, soci al service, religious, and other visit opportunities that meet, or exce ed, the opportunities afforded to criminal inmates. D. Laundry and Bedding Exchange - Upon requ est, and subject to legitimate correctional interests, SSD will provide laundry and bedding ex change opportunities that are less rest rictive than the opportunities afforded to criminal inmates. E. Law Library - Upon request, and subject to legitimate correc tional interests, SSD will provide a ccess to the law library that meet s, or exceeds, the opportunities afford ed general populat ion criminal inmates. F. Use of Tablets - Upon request and subject to technical feasi bility, SSD will provide a tablet to civil det ainees on a priority basis. G. Conditions of confinement no t expressly addressed in this Or der shall be less restrictive than those condi tions offered to criminal inma tes.
