Correctional Services P age 1 of 2 4/03 (REV 7/15) Work Release OPERATIONS ORDER Program Participant D isciplinary Process The purpose of this Order is to p rovide a uniform process for h andling participant discipline. I. General Guidelines The establishment of a discip linary process is mandated by the Minimum Jail Standards. An efficient disciplinar y process assists in mainta ining order, fairly and expediently metes out equal pun ishment for equal violations, an d provides written documentation of each step in the process. II. Required Report Participant Incident Report (Appendix A) III. Initiating the Report A. When a participant commits a violation of rules, the reporti ng officer will: 1. Prepare the Participant In cident Report (Appendix A) within 24 hours of the discovered offense. 2. Submit report to the supervisor for review. 3. Ascertain if the participant wishes to waive the 24-hour wai ting period and note the decis ion in the report. 4. Give the accused a copy of the report. 5. Note the date and time the repor t copy is given to the parti cipant on the face of the report. 6. Advise the participant to ret ain the copy and bring it to th e hearing. 7. If the participant wishes to w aive the 24-hour waiting perio d, the hearing will be held immediately by the assigned hearing office r. 8. If the participant does not wis h to waive the 24-hour waitin g period, the hearing shall be held as s oon as possible once the 24 hours Correctional Services Page 2 of 2 4/03 (Rev 4/16) Work Release has lapsed, but not more than 72 hours later (72 hours equals 3 custody days for SWP participants). IV. Hearing Process A. The hearing will be conducted by a sergeant or their designa te. The sergeant will: 1. Enter the disposition on the violation continuation form and give a copy to the participant 2. The violation report and com pleted continuation form will be submitted to the Division Commander or his designee. V. Booking Officer Responsibilities A. After the process has been co mpleted and appr oved, the repor t will be returned to the booking officer w ho will make copies and distri bute them as follows: 1. Copy to participant’s permanent custody file (a) Original copy to the facility file B. The disposition will be entered into t he participant’s cross reference VI. Approval of Division Commander or Designee Absent emergency conditions, no disciplinary action, including roll-ups, shall be taken against a participant without the approval of the Division Comm ander or his designee. VII. Appeals Process A. Participants or officers wis hing to appeal the decision of t he hearing officer may submit an appeal, in writing, t o the Work Release Division Commander within five days fo llowing the hearing/action. B. The Division Commander will make a final disposition within 20 days of receiving the appeal. Appendices: Appendix A, Incident Report References: Minimum Jail Standards 1218
