Correctional Services P age 1 of 5 3/17 (REV 4/13) MJ/RCCC Preventing, Detecting, Responding to Inmate or Detainee Sexual Assault The purpose of this Order is to standardize procedures for prev enting, detecting, responding to and documenting inmate sexual assaults at the Sacramento County Main Jail (Main Jail) and the Rio Cosumnes Correctional Center (RCCC) i n accordance with the requirements set forth in 28 CFR Part 115 ( National Standards to Prevent, Detect, and Respond to Prison Rape) also known as the Prison Rape Elimination Act of 2003 (PREA) and Title 15, Article 1, Section 3007 of the California Code of Regulations. I. Policies A. The Main Jail and RCCC shall maintain a zero-tolerance policy regarding sexual abuse of inmates. B. The Main Jail and RCCC shall designate a PREA point of contact to coordinate compliance of the facility. C. The Main Jail and RCCC shall maintain sexual abuse screening during the classification and reclassification of new, transferred, or temporary inmates or detainees. The info rmation obtained during the scree ning shall be used to determine the most appropriate housing for the inmat e. During this process, the inmate shall be educated regarding his/her ri ghts to be free from sexual abuse and sexual harassment and to be free fro m retaliation for reporting such incidents, and regarding agency policies and procedures for responding to such incidents (28 CFR 115.33). D. The Main Jail and RCCC shall maintain a classification policy which disallows the use of sexual assault victimization or probable v ictimization as the sole reason for classifying an inmate as a total separat ion (Correctional Services Operations Order 6/03 (Rev 12/09) - Clas sification Process). E. The Main Jail and RCCC shall maintain a written staffing plan that provides for an adequate level o f staffing to prevent, detect a nd respond to allegations of inmat e sexual assault. Correctional Services P age 2 of 5 3/17 (REV 4/13) MJ/RCCC F. The Main Jail and RCCC shall maintain annual staff training for facility personnel, including sworn, non- sworn, and volunteer personnel. T h i s training will explain their responsibilities in preventing, rec ognizing and responding to inmate sexual assaults. G. The Main Jail and RCCC shall ensure staff compli ance with departmental policies and procedures through random and unannounced audits a nd facility checks. These audits and facility checks shall be doc umented appropriately in log books and/ or official correspondence. H. The Main Jail and RCCC shall notify outside entities and allied agencies of PREA standards. Any contract or contract renewal shall conta in language which complies with PREA standards. I. The Main Jail and RCCC shall place and maintain signs in each housing unit notifying all inmates and det ainees of the Sacramento Coun ty Sheriff’s Department’s zero-tole rance policy against sexual ass ault, with a listing of the telephone number(s) to call if anyone wishes to report an incident. II. General Procedures for Screening and Classification; A. The intake classification and reclassification officer will ask the following questions as a part of all cl assification interviews: 1. Have you been the victim of an unreported sexual assault? 2. If you are sexually assaulted, or become aware of another in mate being sexually assaulted while in the custody of the Sacramento County Sheriff’s Department, are you aware that you can confidentially report the crime? B. The intake classification and reclassification officer will read the following statements as a part of all classification interviews: 1. “The Main Jail and RCCC have a zero tolerance policy regardi ng sexual abuse.” 2. “You may report any unwanted s exual contact to any officer, medical worker, mental health worker, or social worker either i n person or on an Inmate Grievance form. You may also report a sexual assault to WEAVE Inc. by using the speed dial *222 or th e confidential information tip lin e by using the speed dial *411. If you desire, your information will be kept confidential.” C. In accordance with Sacramento County Sheriff’s Department Op erations Order 06/03 (REV12/09) – Classif ication Process, the inmate cla ssification process will allow for the prot ection, if desired, of the follo wing parties involved in a sexual abuse case without threat of retaliation: Correctional Services P age 3 of 5 3/17 (REV 4/13) MJ/RCCC 1. Victim 2. Witness 3. Reporting Party III. Sexual Assault Respons e Team Responsibilities A. Jail Social Workers 1. In preparation for the possibility of an inmate sexual assau lt, all Jail Social Workers will take part in annual training with WEAVE Inc . which addresses the fo llowing subject areas: a. Responding to a sexual assault b. Victim advocacy c. Special needs victim assistance d. Same-sex sexual assault e. Responding to sexual assault in custody facilities 2. Additional coordination between Jail Social Workers and WEAV E Inc. will include: a. Intra-agency reporting of sexual assaults b. Completion of quarterly statistics c. Completion of a combined ann ual report between
