Page 1 of 21 16/12 (Rev 1/89) Cost Recovery Related to State , City and Federal Prisoners The purpose of this Order is to a ssign responsibility for colle ction, reporting, and recovery of specified funds expended by this Department when pr ocessing state, city, and federal prisoners. I. Cost Recovery Guidelines Pursuant to Sections 4750 and 4751 PC, a city or county shall b e entitled to reimbursement for reasonable cos ts connected with state prisons or prisoners in connection with any of the following: A. Any crime committed at a sta te prison, whether by a prisoner , employee, or other person. B. Any hearing on any return of a Writ o f Habeas Corpus prosecu ted by or on behalf of a prisoner. C. Any trial or hearing on the question of the sanity of a pris oner. D. Any costs not otherwise reim bursable under Section 1557 PC o r any other related provision in connection with extradition proceedings fo r any prisoner released to hold. E. Any costs incurred in transpor ting a prisoner within the hos t county or as requested by the prison facility or incurred for increased secu rity while a prisoner is outside a state prison. F. The costs of guarding o r keeping the prisoner. G. The cost of transportation of a prisoner. H. The cost of detention of a pri soner in a county correctional facility. I. Any other costs reasonably incurred by a county in connectio n with any matter set for in 4570 PC. II. Responsibilities Chief deputies and division commander s shall ensure reports req uired by this order are submitted in a time ly manner. The report submission i s the responsibility of each division a ffected. The Administrative Di vision shall prepare Page 2 of 21 16/12 (Rev 1/89) a quarterly report with reimburse ment totals and forward the re port to the Sheriff, Undersheriff, each chief deputy, and the division commanders of the affected divisions. III. Frequency The reports are due 15 days after the last day of each month. R eports are due each month even if no ac tivity has occurred. IV. Reimbursement Under Section 4750 PC A. Security Services: 1. For each court appearance by a state prisoner, the court bai liff shall provide the following: a. Name of prisoner b. CDC number c. State institution d. Superior or Municipal Court e. Criminal Charge f. Court Date g. Name, rank, and badge number of deputy h. Time into and out of court i. Total hours of all Court Sec urity services personnel are involved in while providing security for the appearance. 2. The reports shall be grouped by e ach prisoner’s name (Append ix A) 3. For each transportation of a s tate prisoner, the transportat ion coordinator shall provide the following: a. Name of prisoner b. CDC number c. Court case number d. Criminal charges e. Date of transport Page 3 of 21 16/12 (Rev 1/89) f. Name, rank, and badge number of transportation officer(s) g. Whether the transportation is pick-up or return. h. Number of prisoners per vehicle i. Miles transported j. Hours (regular and overtime ) expended by the transportation officer(s). 4. Reports shall be grouped by each prisoner’s name (Appendix B ). B. Patrol Services 1. Patrol Services shall provide reports to the Administrative Division whenever Patrol Services resource s provide/assist with security for state prisoners. Reports shall include: a. Prisoner name b. CDC number c. State institution d. Criminal charges e. Date of assistance f. Name, rank, and badge num ber and hours expended (regular and overtime) of all officers involved in transportation services. g. Description of equipment invol ved including hourly rate or helicopter time (see Appendix C). C. Main Jail Division 1. The Main Jail Division shall provide a report which details 4750 PC state prisoners housed at county fa cilities (including Main Jai l, WDF, medical detention detail, e tc.). The report shall include: a. Prisoner name b. CDC or CYA number c. Criminal charges pending d. State institution Page 4 of 21 16/12 (Rev 1/89) e. Court case number f. Date admitted and date released. 2. Leave the total days held blank (Appendix D). D. Special Investigations Detail 1. The Special Investigations Det ail shall provide reports to t he Administrative Division regardi ng any resources that are provid ed to assist with security for sta te institution prisoners. Report s shall include: a. Prisoner name b. CDC number c. State institution d. Criminal charges e. Date of assistance f. Hours expended (regular and overtime) for Special Investigations officer(s) in volved in the transportation. g. Name, rank, and badge number o f Special Investigations officer(s) involved in the transportation. h. Number of prisoners escorted i. Whether transportation i s pick-up or return. j. Vehicle mileage 2. See Appendix E V. State Prisoners Other Than 4750 PC The Rio Cosumnes Correctional Cent er shall provide reports incl uding all state prisoners housed for adult parole holds, juvenile parole holds, and revocation hearings. The report shall be pre pared using state forms (Appen dices F through H). VI. Federal Prisoners
