Page 1 of 2 15/08 (NEW 2/10) Lactation Breaks The purpose of this Order is to provide policy for reasonable a ccommodation to employees desiring to express br east milk at work for their inf ant child. I. Policy It is the policy of the Sacrament o County Sheriff’s Department to provide a reasonable amount of break time and appropriate facilities to a ccommodate any employee desiring to express br east milk for their infant child . II. Procedures A. Lactation Break Times 1. Employees shall be allowed a reasonable amount of time for lactation breaks. 2. Employees shall first utilize any regularly scheduled rest o r lunch breaks, paid or unpaid, that they already have. These breaks ma y be extended by a reasonable amoun t of time if necessary for the employee. 3. Though additional la ctation break may be granted, after a sp ecified number of total minutes of combi ned rest, lunch and/or lactatio n break time, paid or unpaid, the em ployee will not be paid for additional lactation break. The s pecified number of total minut es of break before additional lac tation break is unpaid is: Employee scheduled for: Shall not be paid after: Eight (8) hours Eighty ( 80) min. of total break Nine (9) hours Ninety ( 90) min. of total break Ten (10) hours One hundred ( 100) min. of total break Twelve (12) hours One hundred twenty (120) min. of total break Note: Employees scheduled fo r unusual work hours should base the threshold on 10 minutes of c ombined break time for each hou r of regularly scheduled work. Page 2 of 2 15/08 (NEW 2/10) 4. All breaks are subject to t he approval of the employee’s sup ervisor. The supervisor shall grant lactation break time unless taking a lactation break would seriously disrupt departmental operations . B. Lactation Break Locations 1. The Department will make reas onable efforts to accommodate employees wishing to express breast milk for their children by providing an appropriate private location. The location will be as close as reasonably possible to the employee’s work area and wi ll not be a restr oom facility. 2. Employees shall either secure the private location or make i t clear to others that the location is occupied and there is a need for privacy. All other employees shou ld avoid interrupting the empl oyee unless invited or announci ng an urgent situation. C. Storage of Breast Milk Any employee storing breast milk in a refrigerated area open to public use shall clearly label the breast milk as such. No breast milk sha ll be stored at the worksite beyond t he employee’s shift. Related Statutes: Labor Code §§ 1030, 1031, 1032
