1 15/06 (rev 4/00) PREGNANCY/CHILD BIRTH AND RELATED MEDICAL CONDITIONS THIS ORDER PROVIDES FOR RE -ASSIGNMENT , A C C O M M O D A T I O N A N D /OR LEAVE FOR EMPLOYEES AFFECTED BY PREGNANCY , CHILD BIRTH AND /OR RELATED MEDICAL CONDITION (S,) INCLUDING THOSE WHO WORK HAZARDOUS ASSIGNMENTS . I G ENERAL IT IS THE POLICY OF THE SACRAMENTO COUNTY SHERIFF ’S DEPARTMENT THAT EMPLOYEES AFFECTED BY PREGNANCY , CHILDBIRTH , AND/OR RELATED MEDICAL CONDITION (S) WILL BE TREATED THE SAME AS OTHER EMPLOYEES WHO ARE NOT SO AFFECTED , BUT ARE SIMILAR IN THEIR ABILITY OR INABILITY TO WORK . DISPARATE TREATMENT OF THESE EMPLOYEES IS A VIOLATION OF GENERAL ORDER 3/05. THIS ORDER IS INTENDED TO APPLY ONLY TO FEMALE EMPLOYEES WHO ARE PREGNANT , NURSING , CARING FOR THEIR NEWBORN CHILD AND /OR SUFFERING FROM A DEBILITATING MEDICAL CONDITION RELATED TO THEIR MATERNIT Y. II. A DVISEMENT FORM A. U PON NOTICE FROM AN EMPLOYEE THAT SHE IS AFFECTED BY PREGNANCY , CHILDBIRTH , AND OR RELATED MEDICAL CONDITION (S), HER SUPERVISOR SHALL PROVIDE HER WITH THE “PREGNANCY , CHILDBIRTH AND RELATED MEDICAL CONDITIONS ADVISEMENT FORM” (STAFF SERVICES FORM 100-02) FOR HER TO REVIEW AND COMPLETE . (APPENDIX A ) B. T HE ORIGINAL ADVISEMENT FORM SHALL BE SIGNED IN ACKNOWLEDGMENT BY THE DIVISION COMMANDER AND FORWARDED TO THE EMPLOYEE RELATIONS OFFICER FOR ARCHIVING . C. A COPY OF THE ADVISEMENT FORM SHALL BE PLACED IN THE EMPLOYEE ’S DIVISION FILE FOR THE DURATION OF HER PREGNANCY , CHILD BIRTH AND/OR RELATED MEDICAL CONDITION . 2 15/06 (rev 4/00) III L EAVE A. EMPLOYEES AFFECTED BY PREGNANCY , CHILDBIRTH AND /OR RELATED MEDICAL CONDITIONS MAY TAKE UP TO FOUR MONTHS LEAVE USING ACCRUED LEAVE BALANCES , INTEGRATED DISABILITY LEAVE AND /OR UNPAID LEAVE . B. L EAVE IN EXCESS OF FOUR MONTHS MAY BE GRANTED PURSUANT TO GENERAL ORDERS 15/02 AND 15/03, AND COUNTY PERSONNEL POLICY AND PROCEDURE L-2, HOWEVER ANY SUCH LEAVE IN EXCESS OF FOUR MONTHS IS NOT CONSIDERED MATERNITY LEAVE OR LEAVE DUE TO PREGNANCY OR RELATED MEDICAL CONDITION (S) FOR THE PURPOSES OF THIS ORDER . 1. E LIGIBLE EMPLOYEES MAY BE GRANTED PARENTAL LEAVE PURSUANT TO COUNTY PERSONNEL POLICY AND PROCEDURE L- 7. SUCH LEAVE IS IN ADDITION TO , AND IS NOT CONSIDERED MATERNITY LEAVE OR LEAVE DUE TO PREGNANCY OR RELATED MEDICAL CONDITION (S) FOR THE PURPOSES OF THIS ORDER . 2. N OTHING IN THIS ORDER EXTENDS THE ELIGIBILITY OF AN EMPLOYEE FOR PARENTAL LEAVE BEYOND THE DURATION SPECIFIED IN POLICY AND PROCEDURE L-7. C. A N EMPLOYEE WISHING TO TAKE MATERNITY LEAVE OR LEAVE DUE TO PREGNANCY OR RELATED MEDICAL CONDITION (S) SHALL NOTIFY HER SUPERVISOR IN WRITING NO LESS THAN 30 DAYS PRIOR TO THE ANTICIPATED COMMENCEMENT OF S UCH LEAVE EXCEPT IN THE EVENT OF AN UNANTICIPATED MEDICAL CONDITION OR AN EARLY BIRTH . SUCH NOTIFICATION SHALL INCLUDE : 1. T HE ANTICIPATED COMMENCEMENT DATE OF SUCH LEAVE 2. T HE ANTICIPATED DATE OF THE EMPLOYEE ’S RETURN TO WORK 3. A STATEMENT FROM A PHYSICIAN CONFIRMING THE PREGNANCY , BIRTH OR RELATED MEDICAL CONDITION (S) AND THE ANTICIPATED COMMENCEMENT AND DURATION OF RELATED LEAVE . IV R EASSIGNMENT A. E MPLOYEES WILL NOT BE REASSIGNED DUE TO PREGNANCY , CHILDBIRTH , AND/OR RELATED MEDICAL CONDITION (S) EXCEPT IN ANY OF THE FOLLOWING CIRCUMSTANCES : 1. A PHYSICIAN IDENTIFIES MEDICAL RESTRICTIONS WHICH CONFLICT WITH THE EMPLOYEE ’S ASSIGNED DUTIES . 2. T HE EMPLOYEE IS UNABLE TO PERFORM HER ASSIGNED DUTIES WITH OR WITHOUT A REASONABLE ACCOMMODATION . 3 15/06 (rev 4/00) 3. T HE EMPLOYEE IS IN A HAZARDOUS ASSIGNMENT AND REQUESTS A REASSIGNMENT IN ACCORDANCE WITH GENERAL ORDER 11/13, MODIFIED DUTY . 4. R EMAINING IN THE ASSIGNMENT POSES A HAZARD TO OTHER EMPLOYEES OR THE PUBLIC . SPECULATIVE OR REM
