Page 1 of 3 15/01 (REV 8/89) Overtime Compensation The purpose of this Order is to e stablish the policy for overti me compensation for employees of the Sacramento C ounty Sheriff’s Department. I. General A. Employees shall only be compen sated for overtime work order ed or authorized by designated supervisory personnel. B. Employees shall indicate on the overtime request form thei r desire to be compensated with either: 1. Cash, at one and one-half times the hourly rate, or 2. Compensating time off, on the basis of one and one-half ho urs off f o r e a c h hour of overtime worked. Consideration will be given to the preference of the employee in accordance with contractual w ritten agreements between the Co unty of Sacramento and the various officially recognized employee org anizations. C. The appointing authority sha ll have the option to specify w hether compensation is paid in cash or compensating time off for ove rtime worked in the case of any sudden or unforeseen situation that requires immediate action and the commitm ent of significant resources. D. Employees who work overtime shall promptly and accurately r eport such time in the manner prescribed by the County. Promptly is def ined in this case as: at the end of the requi red work period, but no late r than your next scheduled work day. E. Compensating time off sha ll be used within one year from t he time the overtime was performed. If t he Department is unable to sched ule and grant the time off within one year, cash payment shall be mad e in lieu of compensating time off. II. Application A. Overtime is defined as the ti me worked by an employee in ex cess of eight hours in one day, or hours in e xcess of normal work day in ca ses of Page 2 of 3 15/01 (REV 8/89) employee working approved modi fied work schedules, or hours i n excess of 40 per week, excluding employ ees on the 7 / 12 program. 1. Occasionally it may be necessary for a supervisor to administratively change an empl oyee’s normal working hours and/or days. In such a case , those hours worked outside of the normal work schedule shall not be considered overtime, excep t for t h o s e hours which exceed ei ght hours per day. 2. Part-time employees shall be compensated for overtime at t heir r egular hourly rate of one hour com pensating time off for each h our w o r k e d i n e x c e s s o f their normal workday or week; provided, however, for work performed in excess of eight hours per day or f o r t y hours per week, they shall be compensated at the overtime r a t e f o r t h o s e e x c e s s i v e hours as provided in Section I, subsection B . B. Except in emergency situat ions and upon request, an employe e shall be authorized compensating time of f or vacation leave for the ne xt contiguous regularly scheduled workday follo wing more than sixteen hours of work in a twenty-four hour period. C. Persons designated as operati ng on flex-time, with mutual a greement between the appointin g authority and the em ployee, may be exc epted from the provisions of this section by the appointing authori ty. III. Exemptions Due to Specified Position Exempt management positions as listed in the current County al pha class table shall not receive overtime co mpensation. They shall be compen sated on an hour for hour compensatory time off b asis for work performed in con nection with the functions which take place in addition to regular duty hours. IV. Jury Duty An employee scheduled to work an evening or morning watch and who is called for jury duty would normally be excused from the regular shift for the duration of the jury duty. If the employee is required to work because of the needs of the Department, and if the number of hours worked plus the number of hours of jury duty, exceed eight hours, t hen those hours worked in excess of eight hours shall be compensated at the overtime rate. V. Suspension of Approved Leave An employee who is scheduled va cation or compensating time off and is required to report to work during thei r normal schedul ed duty hours wil l be considered to have had the vacation or com pensating time off cancelled. If the employee is called in to work other than normal scheduled work hours, the employee shall be Page 3 of 3 15/01 (REV 8/89) compensated at the overtime rat e for those hours worked outsid e the normal schedule. VI. Travel Time Associat ed with Training Programs A. As a general policy, neit her overtime nor management compen satory time off as defined in Section III will be authorized for travel t ime to and/or from training programs within a reasonable commute. Reasonable co mmute is defined as training programs c onducted within fifty one-way m iles of the employee’s point of departure. B. Travel time greater than fifty one-way miles or which keeps
