Correctional Services P age 1 of 7 7/03 (REV 10/19) MJ/RCCC OPERATIONS ORDER Discipline Plan The purpose of this Order is to standardize procedures for admi nistering discipline, establishing rules and penalties for inmate conduct, and to ens ure a fair and impartial inmate disciplinary process in accordance with . Title 15, Cha pter 1, Subchapter 4, Article 7 (Minimum Standards for Local Det ention Standards – Discipline ). I. Policy Inmates accused of violating a facility rule shall be provided a fair and impartial disciplinary process. Discipli ne shall be directly related to the severity of the offense and shall be administered in a firm, fair and consistent manner. II. Compliance with California Code of Regulations Title 15 A. The discipline plan shall be administered in compliance with Title 15 of the California Code of Regulations. B. All inmates being housed will receive an orientation booklet that contains all facility rules guiding inmate conduct and the corresponding dis ciplinary penalties. For those inmates who are illiterate or unable to r ead English, and for persons with disabilities , verbal instructions or mater ial in an understandable form regarding jail rules and disciplinary proce dures and penalties will be provided. C. A copy of the inmate orientation book describing the inmate discipline plan, rules and penalties shall be kept at the Public Counter/Gatehou se and shall be made available to t he public upon request. III. Disciplinar y Counseling A. For purposes of this order, “disciplinary counseling” is the admonishment or instruction of an inmate regarding jail rules or behavior under circumstances other than those warranting i mmediate emergency action. B. Custody staff, in the presence of a supervisor, may conduct disciplinary counseling to address behavioral issues which do not require im mediate or emergency action, or to address misconduct or rule violations d iscovered after the occurrence. Any informal counseling of inmates by cus tody staff (with or without reference to a corresponding Incident/Informat ion Report) shall only be conduc ted within the following guidelines: Correctional Services P age 2 of 7 7/03 (REV 10/19) MJ/RCCC 1. Disciplinary counseling under these circumstances shall take place only with a supervisor’s approval and presence. 2. Disciplinary counseling sha ll not include the use of force u nless otherwise necessary within the m eaning of the “Use of Force” operations order. 3. The counseling shoul d be documented in t he Housing Unit Logb ook at the time of the occurrence to include: Time and location of occurrence, name(s) of inmate(s) , officers and supervisor prese nt. IV. Limitations on Disciplinary Actions A. Discipline shall be implement ed in accordance with all appli cable laws and regulations, including but not limited to Forms of Discipline ( Title 15, Section 1082 and Limitations on Disciplinary Actions (Title 15, Section 1083). No inmate may be deprived of the implements necessary to maintain an acceptable level of personal hygiene. Inmates will be allowed to keep or be provided with a toothbrush, toot hpaste, soap, shaving implement s, comb and tampons/sanitary napkins for female inmates. Inmates will b e allowed to shower at least every other day. 1. While on disciplinary isolati on, prisoners are allowed to ke ep the above items, a bible, one book, and all legal materials to incl ude paper/envelopes/pencil for legal correspondence. V. Crime Report Procedures A. Custody staff investigating a possible criminal offense may complete both an Incident Report Detail (PF10) for a major violation of facil ity rules and a Crime report. B. Any inmate being interrogated fo r violating a criminal statu te shall be read the Miranda warning. C. There is no double jeopardy in disciplining an inmate for a violation of facility rules and, at the same time, referring the case to the district attorney for prosecution. Internal disciplin ary action is an administrative process, separate from a crimi nal prosecution. VI. Major Incident Report Procedures A. Non-sworn custody staff who wish to report or take disciplin ary action towards an inmate shall contact the appropriate deputy responsi ble for supervising the inmate. B. Major facility violations shall be punishable by any of the discipline listed in the applicable regulations, as well as loss of commissary privi leges, social visits, dayroom/outdoor recr eation, telephones, housing unit pr ograms, Correctional Services P age 3 of 7 7/03 (REV 10/19) MJ/RCCC removal from inmate worker status, relocation, loss of good tim e, and disciplinary isol ation housing. 1. The assistant division commander may suspend an inmate’s punishment for a facility violat ion pending any further rule vi olations. C. Deputies and other designated staff who witness an inmate vi olate one or more major facility rules and complete an Incident Report Detai l (PF-10) shall do so by the end of watch. D. Deputies shall notify the inma te of the violation and should p r o v i d e t h e inmate an opportunity to state hi s/her side of the story prior to writing a report. 1.
