Field Services Page 1 of 2 06/05 (REV 1/04) Concurrent Jurisdiction The purpose of this order is to e stablish procedure in cases wh ere concurrent jurisdiction exists between the Sacramento Sheriff's Department and incorporated cities or military facilities wit hin Sacramento County. I. Crimes Occurring In Areas Of Sheriff's Department Jurisdicti on A. When a crime occurs within t he unincorporated area of the Co unty of Sacramento, and officers of the S heriff's Department pursue the suspect(s) into an incorporated city limits, the Sheriff's offi cers will take custody of the suspect. B. If a suspect is taken into custody by a city police departme nt for a crime committed in the unincorporated area, a Deputy may respond and take custody of the suspect after obtaining a supervisor's approval. C. The same procedure will apply when a converse situation invo lving a City Police Department occurs. D. If a Sheriff’s officer detain s a suspect for suspicion of dr iving under the influence, the CHP wil l be requested to respond to conduct the investigation if the violation fo r which the driver has been st opped occurred in the unincorporated ar ea of the county. If the viol ation occurred in a city, that city’ s police department will be respo nsible for conducting the investigation. II. Crimes Occurring In Areas Outside Department Jurisdiction A. In instances where an office r of this department observes a crime that occurred other than in the unincor porated area of Sacramento, a nd/or makes an on-sight arrest for a crime occurring outside of the S heriff's Department jurisdiction, the resp onsible law enforcement agency shall be notified and the case and any s uspect(s) will be turned over to the agency having jurisdiction. If for any reason our department is reque sted to book the suspect(s) or conduct addition al investigation, the officer may do so. A report shall be prepared containing all pertinent information a nd be classified as "Assist ance Outside Agency." Field Services Page 2 of 2 06/05 (REV 1/04) B. The Sheriff's Department Recor ds Section will forward a copy of the report to the appropriate law enforcement agency. C. If an officer is off duty a t the time of an arrest, the on-d uty Field Services Watch Commander and the officer' s Division Commander shall be n otified. III. Military Facilities A. Jurisdiction for offenses o ccurring on military facilities i s affected by the location of the offense and by t he status of the violator. B. Military facilities can be com prised of three distinct juris dictional properties: exclusive, partial and proprietarily. 1. If the offense occurs on F ederal land that is either exclusi ve or partial, the Federal governmen t (military police, military investigation agency or Federal B ureau of Investigation) has so le authority to investi gate the crime. 2. If an offense occurs within pr oprietorial jurisdiction, loca l civilian law enforcement agencies or the Federa l government may investigate or both. C. Federal police agencies have aut hority to investigate and ar rest violators who are military members regardl ess of the location of the inci dent. The Sheriff's Department will cooperat e with Federal authorities on a case-by- case basis which party has the greater interest in the investig ation.
