Correctional Services Page 1 of 2 6/05.2 (REV 5/16) Work Release OPERATIONS ORDER Failure to Comply Roll-Ups The purpose of this Order is to standardize and provide policy, format, and specifications for the removal of Sheriff’s Work Release Progra m participants for failure to comply with the terms and c onditions of the signed promissor y note. I. Authorization to Collect Fees A. Penal Code Section 4024.2(e) authorizes the collection of fe es from participants to defray the costs of administrating the Work Pro ject Program. B. Penal Code Section 4024.2(d) e mpowers the program to exclude any participant “. . . if it appears fr om the record that the perso n has not satisfactorily complied with t he reasonable rul es and regulatio ns governing the assignment (including the pa yment of fees prescribed in Par agraph (e).” II. Determination of Ability to Pay A. A financial interview will be conducted in the Revenue Colle ction Unit by Collection Services Agents to determine the participant’s finan cial obligations and ability to pay. T he following criteria are use d for this determination: 1. Source and amount of income 2. Monthly expenditures 3. Number of dependents B. Operations Order 6/03.0 prov ides further information for det ermination of ability to pay. III. Documentation A. The Revenue Collection Unit s hall ensure the program partici pant signs a “promissory note” (see 6/05.1), a nd is informed that this note is a binding agreement. Correctional Services Page 2 of 2 6/05.2 (REV 5/16) Work Release B. The program participant shall be advised that refusal to pay will result in removal from the program and taken to jail. C. One “site notice” will be s ent to the job site requesting th e participant’s signature, and informing them of the amount past due on their a ccount. D. One phone call will be m ade to the participant. E. The Revenue Collection Unit w ill keep a computer record of a ll correspondence with the particip ant regarding the status of the ir account. F. If the participant provides p roof of inability to pay due to changed circumstances, then the account will be adjusted accordingly. IV. Removal for Willful Refusal to Pay A. Removal from the Work Releas e Program for willful refusal to pay will include the following violations: 1. Failure to respond to “site notices” 2. Failure to return phone calls 3. Failure to bring account current V. Appeals A. The participant may file a w ritten appeal to the Division Co mmander within five (5) days of being re moved from the program. VI. Reinstatement A. An individual may apply for reinstatement to the Work Releas e Program when the account is no longer delinquent.
