Field Services Page 1 of 2 05/10 (REV 1/04) Section 601 of the Welfare and Institutions Code The Purpose Of This Order Is To Outline Procedures Which Office rs Shall Follow When Handling Youths Described By S ection 601 Of The Welfare And Ins titutions Code. I. Section 601 W & I Code Section 601(a) of the Welfare and Institutions Code reads: "Any person under the age of 18 y ears who persistently or habit ually refuses to obey the reasonable and proper order s or directions of his pare nts, guardian, or custodian, or who is beyond the c ontrol of such person, or who is under the age of 18 years when he violated any ordinance of any city or count y of this state establishing a curfew based sole ly on age is within the jurisdi ction of the juvenile court which may adjudge such per son to be a ward of the court." II. Procedures A. Incorrigible or Beyond Control Youth 1. Place the offender in cu stody; transport him/her to the Neighborhood Alternative Center (NAC). Complete the NAC Acceptance of Non-Secure Cust ody form. A report number is not required. Route the original o f this form to the Records Burea u, consistent with es tablished procedure. OR 2. Refer parents and juvenile dir ectly to the NAC. This course of action is to be taken only when there appears to be no immediat e concern for violence or a crisi s such as might result in harm t o either parent or child or another person. Field Services Page 2 of 2 05/10 (REV 1/04) B. Curfew Violations 1. Issue a notice to appear cit ation to the offender. The juve nile is then to be released to a par ent or responsible adult. If no par ent or responsible adult is available, the Juvenile is to be transport ed to NAC. If the juvenile does not fit c riteria for acceptance at NA C, the juvenile will be transported to t he Juvenile Detention Center f or booking. - OR - 2. Place the offender in custody , as appropriate, and transport to NAC. Complete the NAC Accept ance of Non- Secure Custody form consistent with the above procedure. C. Runaway or Missing Juveniles 1. Place offender in custody, tr ansport to the Neighborhood Alternative Center. Complete t he NAC Acceptance of Non-Secure Custody form. The Missing Person report number must be placed in the upper right hand corner of the form. All requested information regarding the juvenile must be completed within the body of the report. Route the orig inal of this NCR along with a Reclassification/Non-Arrest Cl ear-up form to the Records Bureau , consistent with es tablished procedure. - OR - 2. Release the juvenile to the parents or guardian and complete a SSD Reclassification/Non- Arrest Clear-up Report. III. Alternative Center Acceptance Criteria The Alternative Center does not accept juveniles who fall under the provisions of W.I. 300, W.I. 602, or are on Juv enile Probation. The Alternat ive Center will accept juveniles who fall within their established criteria 24 hours per day.
