Investigation of telephone records
Purpose of the
order The purpose of this order is to establish the procedure to prev ent
notification to a suspect whose phone toll billing records are being used in
an investi gation.
General policy The following lists describe the general policy regarding obtai ning toll
billing records from the telephone company.
A. Toll billing records can be obtai ned from the telephone company
pursuant to a search warrant , court order or subpoena.
B. The telephone company will prov ide automatic notification to al l
subscribers whose to ll billing records have been released to la w
enforcement agencies.
C. This notification to the subscrib er will automatically occur wi thin five
(5) days after the expiration of the final 90-day certification or
recertification
period.
Specific
procedure to prevent notification The following list describes the specific procedure, which shal l be followed
to prevent the telephone company from notifying a suspect of to ll billing
records being released dur ing an investigation.
A. To prevent the telephone company from automatically notifying t he
subscriber of toll billing records being released during an inv estigation,
all personnel shall notify the telephone company security offic e in
writing for renewal of a certification period, prior to the exp iration of
the previous certification.
B. A sample of non-disclosure wordi ng in the court order is:
"Pursuant to an official criminal investigation of a suspected felony
being conducted by the (agency), it is requested that your comp any
furnish on (date) toll record information pertaining to (name a nd/or
telephone number) for the date(s ) of (date) through (date), inc lusive”
C. You are not to disclose the existence of this request for a per iod of 90
days from the date of this request.
D. Any such disclosure could impede the investigation being conduc ted
and thereby interfere with the enforcement of the law."
E. An investigator requesting recer tification can adopt similar wo rding in
the letter he directs to the tele
phone com pany securit y office.
