Detective Division Page 1 of 2 4/02.0 (REV 1/90) OBTAINING REPORT COPIES The purpose of this order is to o utline the procedure whereby p ersons involved in a case may obtain a copy of the report. I. General A. The victim of an incident o r an authorized representative th ereof, an insurance carrier against which a claim has been made, or any person suffering bodily injury or pr operty damage or loss, may genera lly obtain a copy of the entire report if the following conditions are met: 1. The case has been cleared. 2. The request for copies is made in person or by mail to the R ecords Bureau. 3. The incident must be arson, burglary, fire, larceny, explosi on, robbery, vandalism, vehicle theft, or a crime of violence. a. Release of reports regar ding any other incident is discretionary (Section 6254 [f] of the Government Code). Each request is reviewed and a determination regarding release made by the Records Bureau. 4. Casualty Report: The entire c opy of the report shall be rele ased to the victim or insurance company . A relative of the victim (dece ased or incapacitated) will receive only the face sheet. II. Legal Representation A. Report copies will be released to attorneys or the victim’s authorized representative upon receipt of a w ritten release by a person n amed in the report. III. Non-Cleared Cases A. For reports of losses such a s a burglary report, only the fa ce sheet listing the items taken and the point o f entry, if applicable, may be obtained. Detective Division Page 2 of 2 4/02.0 (REV 1/90) B. For other crime reports or r eports of injuries only the face sheet or casualty report may be obtained. C. A fee of $3.00 is charged fo r mail requests; counter fees wi ll be $3.00 for one to four pages; $5.00 for fi ve through nine pages; and $10. 00 for ten or more pages. Personal checks will be accepted and must be made payable to the Sacramento County Sheri ff’s Department (Government Code Section 6257). 1. In the absence of a report, a c opy of the event may be relea sed. The fee is $3.00. IV. Citations A. Copies of citations may be re leased to the person cited or t heir attorney with authorization. The fee is $3.00. V. Records Bureau A. The Records Bureau shall not: 1. Release report copies containing juvenile suspects (reques tor must obtain a Juvenile Court O rder prior to release). 2. Release a report if the reques ting party exhibits any anger or animosity toward any other person(s) mentioned in the report. The Sheriff’s Department has the ri ght to refuse to release a repo rt if doing so would endanger a witness or any other persons involve d in the incident. 3. Disclose that portion of a report which reflects the analysi s or conclusions of the inve stigating officer. 4. Release sex crime or homici de reports without the approval o f the assigned detective or appropr iate bureau supervisor. 5. Release narcotic reports. 6. Release clear ups or supplem entary reports i ndicating that a n arrest warrant has been requested. 7. Release reports or documents wr itten by other agencies; i.e. , medical reports, memos, etc. T hey are the property of the othe r agency, and therefore, must be obtained from that agency.
