Court Security Division P age 1 of 4 4/02 (REV 6/11) Holding Area: Inmate Classi fication and Segregation The purpose of this Operations Order is to define the need and procedure for classifying and segregating in-c ustody defendants being detained at the Gor don D. Schaber Courthouse facility, the Lorenzo E . Patino Hall of Justice (Mai n Jail), the William R. Ridgeway Family Relations Court house, the B.T. Collins Juvenile Courthouse, and the Carol Miller Justice Center. I. Policy In-custody defendants shall be separated and secured in a manne r that ensures the overall safety of other defendants and Sheriff’s staff. II. Separation Guidelines A. Sex of in-custody defendant 1. Male and female in-custody defendants must be separated at a ll times. a. Although both sexes may be detained in the same holding area: (1) Male defendants and fema le defendants shall not be housed together in the same holding cell. B. Age of in-custody defendant 1. Adult and juvenile in-custody defendants must be separated a t all times in accordance with Welfa re and Institutions Code §208. a. Although both age groups may be detained in the same holding area: (1) Adult defendants and juveni le defendants shall not be housed together in the same cell. (2) There shall be no visual contact between adult and juvenile defendants. (3) There shall be no comm unication between adult and juvenile defendants which includes hand-signing. Court Security Division P age 2 of 4 4/02 (REV 6/11) b. California Code of Regulat ions (CCR), Title 15, Minimum (Jail) Standards, Article 10, Section 1161. C. Total separation o f in-custody defendants 1. Defendants that require total s eparation from other in-custo dy defendants due to: a. A history of assaultive/disruptive behavior. b. Criminal sophistication and the potential for escape. c. Seriousness of crime(s). 2. Adult in-custody defendants of t his classification will be i dentified by wearing a green or yellow shir t. They will be chained around t he waist and will have ankle shackles. D. Protective Custody Defendants 1. Defendants that require protect ion from other in-custody defendants due to the following crit eria should be segregated: a. Pending charges b. Sexual orientation c. Gage affiliation d. Mental illness e. Physical disabilities f. Developmentally disabled (1) CCR, Title 15, Minimum (Jail) Standards, Article 5, Section 1057. 2. Defendants that require protect ion from themselves may be segregated: a. Suicidal defendants should be he ld with other defendants when possible. If placed in a hol ding cell by themselves they should be constantly monito red, when possible. At a minimum, they should be visual ly checked twice every 30 minutes at irregular intervals. A ll visual checks should be noted in the log book. (1) CCR, Title 15, Minimum (Jail) Standards, Article 5, Section 1052 Court Security Division P age 3 of 4 4/02 (REV 6/11) 3. Adult in-custody defendants in this classification will be i dentified by wearing a black or purple shirt. E. Civil Commitment Defendants 1. Defendants that are in-custody on a civil matter and have no criminal charges attached to their detention. 2. Defendants of this type may be detained together with like defendants. 3. Penal Code §4001 F. Fresh Arrest Detainees 1. Defendants placed under arrest f or “fresh” criminal charges shall be separated from other in-custody defendants until completion of the formal booking process. 2. Defendants in this classifica tion may be detained together w ith like defendants. G. General Popul ation Defendants 1. All other in-custody defendant s that do not meet the above segregation criteria m ay be house together. 2. Adult in-custody defendants of t his classification will be i dentified by wearing an orange shirt. III. Separation of Responsibilities A. The Holding Officer shall be responsible for obtaining infor mation regarding an in-custody defendant’ s classification status. Cri tical information must be shared among Sheriff’s personnel and other agencies regarding a defendant’s classifica tion status. The information can be obtained from the following: 1. Court Transportation officers 2. Jail staff 3. Juvenile Hall staff 4. Computer automat ed records – JIMS 5. In-custody defendant interview 6. Holding officers assigned to t he B.T. Collins Courthouse wil l visit the Juvenile Hall living units quarterly to gain a better understanding of the Pr obation Department’s classification proc ess. If the classification status of an in-custody defendant chan ges due to an event or issue occurring while in the Court Holding area, the H olding Officer shall: 1. Separate and detain the def endant(s) appropriately. 2. Advise the facility Sergeant. 3. Complete an Incident Report and /
