INVESTIGATION OF TELEPHONE RECORDS
The purpose of this order is to p rovide the procedure to preven t notification to a suspect
whose phone toll billing records are being used in an investiga tion. Note : These records
are only available with a sear ch warrant, court order, or subpo ena.
I. General
The telephone company will provi de automatic notification to al l subscribers
whose toll billing records have been released to law enforcemen t agencies under
a certificate (receipt of a subpoen a, summons, court order, or search warrant) or
recertification for non-disclosur e. This notification to the su bscriber will
automatically occur within five days after the expiration of th e final 90-day
certification or rec ertification period.
To prevent the telephone company from automatica lly notifying t he subscriber of
toll billing records being releas ed during an investigation, pe rsonnel shall notify
the telephone company security o ffice in, writing, for renewal of a certification
period, prior to the expiration o f the previous certification. Failure to do so will
provide automatic notification by the phone company to the subs criber upon
expiration of the certification period failing recertification.
A sample of a non-di sclosure statement:
“Pursuant to an official criminal inve stigation of a suspected felony being
conducted by the (name of agency), it is re quested that your company furnish on
(date) toll record information pertaini ng to (name and/or telephone number) for
the dates(s) of (date th rough date), inclusive.
You are not to disclose the existence of this request for a period of 90 days from
the date of this request. Any such discl osure could impede the investigation
being conducted and thereby interfere wit h the enforcement of the law.”
