Detective Division Page 1 of 2 3/14.0 (REV 1/90) ADDITIONAL CHARGES AND RE-ARRESTS AT THE MAIN JAIL AND RCCC The purpose of this order is to p rovide instructions for placin g additional charges on a person in custody and for re-arr esting a person released per se ction 849b(1) PC I. Main Jail A. Additional Charges: To arres t an incarcerated person on addi tional felony charges, the officer shall: 1. Contact the prisoner and advise them that they are being arr ested for a specific charge. 2. Complete an arrest report and l eave two copies with jail rec ords along with a signed return o f warrant, if applicable. 3. Prepare a case summary. 4. File the report with the District Attorney’s Office. B. Re-Arrests 1. Subjects who are released per S ection 849b(1) PC shall not b e re- arrested by Detective Division personnel on the same charges without a warrant, unless there ar e extenuating circumstances. 2. Where imminent danger may e xist to the public if the person is not re-arrested immediately, the det ective shall request that the D istrict Attorney’s Office expedite the warrant. II. Rio Cosumnes Correctional Center A. Additional Charges 1. The detective will confirm t he inmate’s presence at RCCC and will notify booking of the intent to arrest the inmate on additional charges. The detective will comp lete the arrest report, leaving blank the date, time, and location of th e arrest. The detective also shall complete the Department of Justice disposition of arrest and se nd the arrest report and dispositi on of arrest to RCCC via inter-o ffice mail. The receiving officer (either a deputy or records officer) w ill complete the arrest report (date, time, and location) and sign their name as the assisting officer. 3. The inmate will be called to booking where they will be advi sed of the arrest and shall be finger printed, photographed, if necess ary, and allowed telephone calls. 4. The receiving/assisting offi cer will flag the inmate’s file (unarraigned), and annotate the booking card with the new charges. The officer shall log the telephone calls, route the arrest report, and update the arrest h istory in the computer. 5. If the new charges cause the in mate’s housing security statu s to change, the receiving/assisting officer will make the necessar y changes and annotate the booking card. B. Re-Arrests 1. Subjects who are released per S ection 849b(1) PC shall not b e re- arrested by Detective Division personnel on the same charges without a warrant, unless there are extenuating circumstances. 2. Where imminent danger may e xist to the public if the person is not re-arrested immediately, the detective shall request that the District Attorney’s Office expedite the warrant.
