APPLICATION FOR HIGHER BAIL
The purpose of this order is to outline the procedures for soli citing a higher bail than set
forth in the uniform bail schedule. I. Penal Code Section 1269(c)
A. Penal Code Section 1269(c) permits a peace officer to solic it a judge to
set a higher bail than listed on the uniform bail schedule if he/she feels the
bail set forth in the schedule is insufficient to guarantee t he defendant’s
appearance in court. II. The Initiating Officer shall:
A. Complete a Declaration of Arresting Officer form in quadruplicate
specifically outlini ng his/her reasons for soliciting the incre ased bail (forms
are available in the Main Jail booking office).
B. Give the form to the booking officer processing the arrest.
C. The jail classification offi cer will contact the on-call jud ge regarding the
requested increase in bail.
