Procedures: Change of Ve nue Trial Reimbursement
The purpose of this Operations Or der is to establish guidelines to ensure reimbursement
of funds expended for trials conduct ed in Sacramento County Cou rts as a result of a
Change of Venue. I. Policy
A. In accordance with state law and by mut ual agreement with ot her counties,
only costs for extraordinary serv ices and equipm ent will be bil led to the
county of origin in trials res ulting from a change of venue.
1. Extraordinary services mean additional security personnel fo r high-
risk trials.
2. Extraordinary services do no t include costs associated with normal
staffing levels.
II. Authority
A. A change of venue is permitted w hen the Court believes the d efendant
cannot receive a fair trial in t he county where the case was or iginally filed.
Reasons for a change of venue incl uding pre-trial publicity, bi as, political
atmosphere, and any other circums tances that the parties believ e would
prevent them from obtai ning a fair trial.

B. The receiving court is only authorized to charge the origina ting court for
costs associated with the trial that are above the normal salar ies, overhead,
and expense incurred routinel y by the receiving court.

III. Reimbursement Tracking
A. The Administrative Sergeant shall maintain a monthly liaison with Superior
Court Administration to ensure proper credit is received for an y
extraordinary costs for pers onnel and equipment associated with the
change of venue trial.
