Training Page 1 of 3 3/06.0 (REV 3/91) EMPLOYMENT OF RETIRED DEPUTY SHERIFFS The purpose of this order is to provide policy guidelines regar ding the employment of retired deputy sheriff’s by the Sacramento Sheriff’s Department . I. General A. Pursuant to the County Retire ment Act of 1937, Section 3160. 2, any person who has retired from the Sheriff’s De partment may be emp loyed in a position determined by the Sher iff’s Department not to exceed 960 working hours in any one calenda r year and may be paid for such employment. Such employment sha ll not operate to reinstate the person as a member of the retirement system or to terminate or suspend his retirement allowance, and no ded uctions shall be made from his salary as contributions to the retirement system. II. Eligibility A. Any retired deputy sheriff des iring to participate in the pr ogram may be appointed to call-in status prio r to the expiration of the thre e-year reinstatement period. To initiate reinstatement, the returning retiree must contact the Administrative Divis ion, personnel section, in orde r to complete the required paperwo rk and payroll processing. B. Once the three-year reinstate ment period has expired, a reti red deputy sheriff must be appointed from an e ligibility list or must be p rovisionally appointed. A provisional appointm ent can be made only if no eli gible list exists. Such provisional appointm ent has the limitations and co ntrols of all provisional appointments. C. All appointees will be of good health and shall be medically cleared by the County Department of Education and Training (formerly Personnel Management) prior to appointmen t. No appointee shall be on medi cal or disability retirement status. D. A break in service from the time of retirement will require an appointee to undergo a complete background invest igation prior to appointmen t. Training Page 2 of 3 3/06.0 (REV 3/91) III. Provisions A. Assignment 1. Assignment of a retired deputy sheriff working in an on-call capacity will be made by the reserve forc es coordinator for the division of Training and Reserve Forces. R etirees will not be allowed to wo rk until they have received and ca shed their first retirement allo tment check. B. Salary 1. Appointees shall receive “St ep E” of the deputy sheriff on-c all salary with applicable pay incentives. C. Computing the Work Days 1. Computation sha ll be made upon the tota l number of hours wor ked during a calendar year with a maximum of 960 hours (any vacatio n and/or CTO earned and used will count toward the 960 hour total ). D. Training Requirements 1. It shall be the responsibilit y of the appointee to maintain current training status regarding first a id, CPR, and firearms qualific ation. 2. Firearms qualification shall be required duri ng each qualifi cation period in which the retiree is w orking; i.e., if a retiree work s January, February, and March they must qualify during the first shooting period. If the retiree did not work in September, Octo ber, November and December, the retir ee would not have to qualify fo r that period. If the retiree elec ts only to work a few days each month, then qualification must be comp leted within ea ch shooting perio d. 3. All appointees are required to maintain current training sta tus as set forth by POST and STC. Failure to meet such training requiremen ts may result in termination fr om the 120-day w ork program. E. Uniform Allowance 1. All appointees shall be entitl ed to a uniform allowance in accordance with contractual agreement between Sacramento County and the Sacrament o County Deputy Sheriff’s Association. F. Miscellaneous 1. Retired deputy sheriffs are not covered by 4850 benefits; su ch benefits are applicable only to i ndividuals employed on a regul ar, full time basis. Retirees are e ligible for normal workers’ compensation temporary dis ability and medical benefits. Training Page 3 of 3 3/06.0 (REV 3/91) 2. A retired deputy sheriff who is disabled in the course of te mporary employment as a deputy sheriff on- call cannot obtain a disabili ty retirement allowance from the Co unty retirement system for inju ries suffered during the course o f the temporary employment. Temporary employees are not cov ered by the Sacramento County Employees’ Retirement System.
