3/05 (REV 10/05) Page 1 of 3 Discrimination and Sexual Harassment The purpose of this Order is to p rovide policy related to prohi biting discrimination and sexual harassment in the Department. I. References A. County Personnel Policies and Pr ocedures H-3: Discrimination in County Employment B. County Personnel Policies and Procedures H-4: Sexual Harassment in County Employment II. Policy A. All Department member s are prohibited from discriminating or engaging in sexua l harassment. III. Consequences A. Any Department member who engages in discrimination or sexua l harassment is subject to adverse disciplinary action up to and including termination. IV. Reporting Responsibility A. Each employee who witnesses di scrimination or sexual harassm ent has a responsibility to address it or report it to a supervisor , even if he or she is not the direct recipient of such conduct. B. Each manager and s upervisor has a duty to address discrimina tion and sexual harassment. Failure to take appropriate action when aware of such conduct is grounds for disciplinary action. 3/05 (REV 10/05) Page 2 of 3 V. Filing a Complaint A. Method of notification: Wri tten complaints are highly recommended. Refer to the County’ s H-3 and H-4 policies for details. B. Who to notify: Any Department member who believes he or she has been the victim or witness of unlawful di scrimination or se xual harassment or retaliation, in vi olation of County policy, is encouraged to file a complaint with any of the following individuals: 1. his/her supervisor 2. his/her manager 3. Fair Employment Officer 4. Human Resources Manager 5. County’s Chief of Equal Employment Opportunity 6. Department Head. VI. Investigation A. Time sensitive: All complain ts of discrimination and sexual harassment will be prompt ly investigated. B. Coordinated effort: Superviso rs and managers shall work wit h the Fair Employment Officer to ensur e the investigation is thorough and accurate, and that any prompt cor rective or disciplinary action is taken. C. Protection from retaliati on: Supervisors, managers, and the Fair Employment Officer will take a ll reasonable measures to ensure that anyone involved in the inve stigation is protected from retaliation. D. Providing results of the inve stigation: The complainant and the accused will be given a Letter o f Disposition indicating the fi ndings of the investigation. E. Relevant General Orders: Gener al Orders 3/01, 3/02, and 3/0 3 must be followed for any investi gation where disciplinary actio n is recommended or taken. 3/05 (REV 10/05) Page 3 of 3 VII. Maintaining Investigative Records A. Who maintains: The Fair Emplo yment Officer maintains record s of all investigations conducted by Sheriff’s D epartment staff. B. Confidentiality issues: To t he extent permitted by law, pro ceedings under this Order and all reports and records filed shall be kep t confidential. Reasonable efforts shall be made to protect the privacy interests of the parties . Information will be given on ly to those who have a need to know. VIII. Distribution of General Order A. This General Order and the a ttached Employee Feedback Form (7400-170) will be given to employ ees at the time of their hire and during every performance evaluation process. It is the responsibil ity of all Department members to curtail offensive or unwelcome behavior in the wor kplace and, when necessary, advise a supervisor or manager of this sort of behavior.  I have been made aware of and understand that if such conduct o ccurs to me or if I observe it occurring, I should immediately speak with my immedi ate supervisor (if appropriate). If I desire, I can go outside the c hain of command and report s uch conduct directly to the following individu als or agencies: - Sheriff’s Department F air Employment Officer - County’s Chief of Equal Employment Opportunity - State Department of Fair Employment and Housing - U.S. Equal Employment Opportunity Commission.  I have received a current copy of G eneral Order 3/05 – Discrimi nation and Sexual Harassment and the County’s Personnel Policies and Procedures H -3 and H-4.  I understand the discrimination a nd sexual harassment policy an d have no discrimination and/or harassment is sues or incidents that are o f a concern to me, nor am I aware of any discrimination and/or sexual harassme nt issues or incidents involving any other employee.  I understand the discrimination and harassment policy and would like to speak with a supervisor or manager regarding issues of discrimination and/or harassment.
