Procedures: Court Releases
The purpose of this Operations Or der is to define the policy an d responsibility of the
Court Security Division for the release from custody of defenda nts detained for legal
proceedings at any Sacramento C ounty Superior Court facility.
I. Policy
A. Court Security personnel shall process in-custody defendants who have
received a release during a c ourt proceeding in a manner that e nsures no
defendant remains in custody longer than necessary.
B. In-custody defendants shall not be released from custody by Court
Security personnel.
1. Except those appearing on civil contempt warrants at the Rid geway
Courthouse by the dire ction of the Court.
a. These defendants are brought into civil court directly from
the street, usually by a deput y assigned to the Sacramento
County Department of Child Support Services, or the Sacramento County Departm ent of Revenue Recovery.
b. They are not processed through the Main Jail.
(1) They are processed “into custody” and “out of
custody” through the Hold ing Area of the Ridgeway
Courthouse.
II. Reasons for a Court Release
A. During a court appearance, an in-custody defendant may be gr anted a
release from custody on a parti cular court case for the followi ng reasons:
1. Own Recognizance (OR) 2. Charges Dismissed 3. Acquittal 4. Diversion Program

6. Stay of Execution of Sentence 7. Release on a Civil Contem pt Warrant – Time Served
III. Procedure for Court Release
A. In-custody defendants receiving a court release shall be pro cessed and
released at the Main Jail or at Juvenile Hall.
1. Defendants will not be released fr om custody until the case release
information is entered in JIM S by Court personnel and the
correctional facility completes it s internal release procedures .
2. Defendants appearing on a civil c ontempt warrant at the Ridg eway
Courthouse may be released dir ectly from that facility by the
direction of the Court.
B. The custody status and classi fication of the released defend ant shall
remain unchanged.
C. Officers will not change (lower) security measures when proc essing the
defendant.
D. Officers will not circumvent s tandard processing procedures to expedite
the return of the released defenda nt to the Main Jail or Juveni le Hall.
E. Court Security supervisors have the authority to modify the release
process to fit a particular situation.
