Procedures: Arrests
The purpose of this Operations Or der is to define the procedure s to follow in the event a
subject is arrested or remanded in to the custody at a Sacrament o County Superior
Court facility. I. Policy
A. The Sheriff has legal responsib ility for enfor cing state and local laws in the
County of Sacramento. Persons ta ken into custody will be held in a safe
and secure holding facility until they are transported to the M ain Jail.
II. Authority
A. The Sheriff shall arrest all persons who attempt to commit o r who commit
a public offense.

B. A peace officer may arrest a person in obedience to a warran t.

C. A magistrate may orally order a peace officer to arrest anyo ne committing
or attempting to commit a public offense.

D. When a defendant who has posted bail appears for trial, the Court may, in
its discretion at any time a fter the defendant’s appearance, or der them to
be remanded into custody

E. Any individual that is not a d irect transfer from a correcti onal facility who is
detained in a court facility holdi ng cell, must have a medical screening
questionnaire completed regarding their medical and mental heal th history

Standards, Article 11, Section 1207.
III. Court Remands
Court Security Division P age 2 of 4 3/01 (REV 6/11) A. If a non-custody individual app earing in court is remanded b y the Court to
be taken into custody, the bailiff shall:
1. Notify Court Control and reques t an additional officer to as sist.
2. Complete the “Court Dispositio n and Commitment” (form # SSD-
742 FORM 1) completely and accurately.
a. This form is sometimes ref erred to as a “Mini-Dispo.”
b. The Court Disposition and Commi tment form is required for:
(1) Defendants remanded to the custody of the Sheriff by
the Court.
(2) All in-custody juvenile defendants.
(a) The Court Dispositio n and Commitment form is
needed any time a juvenile appears in court even if no further ap pearance is required.
(b) The Court Dispositio n and Commitment form is
returned to Juvenile Ha ll with the juvenile.
(3) All criminal or civ il in-custody witnesses.
(4) Disseminating any special instructions for the Main
Jail.
(a) Any change in bail or c ustody status should be
highlighted on the form.
3. Handcuff and pat-search the individual for weapons and
contraband.
4. Escort the individual to the se cure holding area of the faci lity.
5. An officer will complete t he appropriate Main Jail booking
paperwork.
6. The Holding Area Officer will arrange for transportation of the
individual to the Main Jail or J uvenile Hall, whichever is appl icable.
IV. Warrant Arrest
A. If an individual appearing in court has an outstanding arres t or bench
warrant:
1. Felony warrant:
a. Outside agency - Confirm t he warrant is still active.

warrant.
2. Misdemeanor warrant (s) (non-traffic):
a. Arrest or refer the subject to the appropriate law
enforcement agency to set a court date.
3. Misdemeanor warrant(s) (traffic):
a. Arrest if warrant is “No Bail. ” Refer all other individuals to
the appropriate law enforcemen t agency to set a court date.
B. Request an additional officer standby.
1. Advise the subject of y our intention to arrest.
2. Handcuff and pat-search the s ubject for weapons and contraba nd.
3. Escort the subject to the secu re holding area of the facilit y.
C. Complete the Main Jail booking paperwork.
D. Holding Officer will arrange fo r transportation of the subje ct to the Main
Jail or Juvenile Hall, w hichever is applicable.
V. Fresh Arrests
A. If the subject appear ing in court commits a crime at the fac ility:
1. Request an additional office r standby, if time permits.
2. Advise a facility sergeant. 3. Handcuff and pat-search the s ubject for weapons and contraba nd.
B. If the crime committed is a felony:
1. Secure the subject i n the Holding Area.
2. Obtain a report num ber from Records.
3. Complete the Main Jail booking paperwork.
4. Arrange for transportation of t he subject to the Main Jail o r Juvenile
Hall, whichever is applicable.
5. Complete a Crime Report
C. If the crime committe d is a misdemeanor and:

a. Secure the subject i n the Holding Area.
b. Obtain a report num ber from Records.
c. Complete the Main Jail booking paperwork.
