Security Services Page 1 of 3 01/10 (REV 01/06) Sheriff’s Security Officers’ Power to Arrest The purpose of this Order is to e stablish guidelines for the ar resting authority of Security Officers assigned to the Security Services Bureau. I. General Sacramento County Sheriff's Secu rity Officer authority is defin ed by the California Penal Code Section 8 31.4. A Sheriff's Security Offi cer is a public officer, employed by the Sheriff, whose primary duty is the security of locations or facilities as d irected by the Sheriff. The dut ies of a Sheriff's Security Officer shall be limit ed to the physical security and protection of properties owned, operated, contro lled, or administered by the county, or any municipality or special distri ct contracting for police ser vices from the county pursuant to Section 54981 of the Government Code, or nec essary duties with respect to the patr ons, employees, and properties o f the employing county, city, o r contracting entities. II. Powers of Arrest A Sheriff's Security Officer is not a peace officer, nor a publ ic safety officer as defined in Section 3301 of the Government Code. Sheriff's Se curity Officers may not exercise the powers of arrest of a peace offic er, but are authorized to issue citations for infractions. A Sheriff's Security Officer a ssigned to the Security Services Bureau may arrest a person: A. For a public offense committed or attempted in his/her prese nce, B. When the person arrested has committed a felony, although no t in his/her presence, C. When a felony has, in fact, been committed, and the security officer has reasonable cause for believi ng the person arrested to have committed it. Security Services Page 2 of 3 01/10 (REV 01/06) III. Warrant Arrests Sheriff's Security Officers assigned to the Security Services B ureau may arrest a person pursuant to a warrant only if: A. The officer has knowledge of a valid warrant, and B. The warrant requests an immediate arrest, and C. A peace officer has aut horized the arrest, or D. The warrant is for a violent felony. IV. Detentions Sheriff's Security Officers assi gned to the Security Services B ureau shall not detain a person for any reas on except for the purpose of is suing a citation for an infraction. V. Procedures for Making Non-Warrant Arrests When a security officer has made an arrest in accordance with t his policy, the officer shall: A. Immediately notify Security S ervices Bureau Central Control. B. Notify a Security Services Bu reau Field Deputy, via the radi o, as soon as possible. C. Notify a Security Services Bureau Supervisor as soon as poss ible. D. Turn the arrest over to a peace officer when they arrive. E. Complete any reports or requi rements associated with the arr est. F. Make a log book entry of the activity. G. If no Security Services Bur eau Supervisor or Bureau Field De puty is available, a peace officer fr om the agency having jurisdiction shall be requested as soon as possible. VI. Procedure for Making Warrant Arrests When a security officer has knowledge of a warrant for a person 's arrest, the officer shall weigh the seve rity of the crime declared in t he warrant as it applies to the benefit of making the arrest. If the securit y officer has determined an arrest is necessary and the warrant is for a viol ent felony, the officer may arrest the pers on. If the warrant is not for a violent felony, the officer shall immediately re quest authorization to make the arrest from a Security Services Bureau Superv isor or a Bureau Field Deputy. Absent authorization in accordan ce with this order, no arrest u pon a warrant, other than a warrant for a violent felony as defined i n Section VII of this order, shall be made. Nothing in this policy shall proh ibit a security officer from a rresting a Security Services Page 3 of 3 01/10 (REV 01/06) person who has a warrant when t he person has committed a public offense according to Section II, Subsection A, B, or C of this policy. Violent Felony Define For the purposes of this policy , violent felony is defined as: A. Murder or volunt ary manslaughter. B. Mayhem. C. Rape D. Sodomy by force, violence, dur ess, menace, or fear of immedi ate and unlawful bodily injury on t he victim or another person. E.
