ORANGE COUNTY SHERIFF'S OFFICE TRAINING BULLETIN Effective Date: June 27, 2017  Amends - TB 95 -13 (June 25, 2010) Number: 95-13 Distribution: All Personnel Review Month: October Reviewing Authority: UPD / Division Commander Subject: Victim N otification This training bulletin establishes procedures for implementing FS 960.001 , Victim Notification, effective October 1, 1995. 1. Procedures A. The Victim Notification Card will be filled out when an arrest is made or when filing at large for the following crimes: 1. Homicides, pursuant to Chapter 782; 2. Sexual offens es, pursuant to Chapter 794; 3. Attempted Murder or Attempted Sexual Battery, pursuant to Chapter 777; 4. Stalking, pursuant to Chapter 784.048 ; 5. Domestic Violence, pursuant to Chap ter 741; and 6. Dating Violence, pursuant to Chapter 784.046 B. Card completion 1. It is the responsibility of the deputy who is physically making the arrest, or completing the paperwork to file at large, to complete the Victim Notification Card and attach it to the report. 2. The deputy shall verify the name and address of the “victim, appropriate next of kin, or other designated contact of victim,” are printed on the front side of the Victim Notification Card. The deputy shall write the case number under the return address on the front side of the card. 3. The deputy shall also write the case number, offense, defendant’s name, victim’s telephone number and age level on the reverse sid e of the Victim Notification Card. 4. The victim may provide an alternate address and/or telephone number, other than his/her primary residence, if he/she so desires. C. Victim Declination 1. The deputy should encourage the “victim, appropriate next of kin, or other designated contact of victim” to provide information for completion of the 95-13, Page 2 of 3 Victim Notification Card. However, the statute allows victims to have the option to waive notification. In these instances, the “victim, appropriate next of kin, or other designated contact of victim” is to sign the declination on the front of the completed Victim Notification Card. 2. This declination is to be distributed in the same manner provided in (D) and (E). D. Physical Arrest 1. The arresting officer shall attach the hard copy of the Victim Notification Card to the Arrest Affidavit which is to be left at CBO or JAC. 2. The other two (2) copies, one for the Sheriff’s Office Records Section and one for the State Attorney’s Office, will be attached to the Inci dent Report to be reviewed by the supervisor. 3. When the paperwork is separated for distribution, the original (Records) copy of the Victim Notification Card should be attached to the Records copy of the Incident Report. The remaining copy of the card s hould be attached to the State Attorney’s copy of the paperwork. E. Filing at Large 1. The Victim Notification Card will be filled out completely. 2. All three (3) copies of the card will be attached to the paperwork. 3. When the paperwork is separated for distribution, the original (Records) copy of the Victim Notification Card should be attached to the Records copy of the Incident Report. The State Attorney’s copy and the hard card copy of the Victim Notification Card should be attached to the paperwo rk that is to be forwarded to the State Attorney’s Office. F. Warrants Arrest 1. When a deputy makes a warrant arrest, he or she shall leave a copy of the Victim Notification Card attached to the Warrant Arrest Affidavit at CBO or JAC. 2. When a warrant arrest is made pursuant to a teletype hit, Warrants Unit personnel should determine if a Victim Notification Card is attached to the warrant. 3. Both sides of the Victim Notification Card should be faxed to CBO or JAC along with the Warrant so that the ar resting deputy may attach the faxed card to the Warrant Affidavit which is to be left at CBO or JAC. 4. Warrants shall daily send the (previously faxed) Victim Notification Cards to CBO or JAC, via interoffice mail. G. Multiple Victims 95-13, Page 3 1. In the event t here is more than one victim in a case, a Victim Notification Card should be completed for each victim. 2. Card distribution will remain the same. H. Multiple Defendants 1. In the event there is more than one defendant in a case, a separate Victim Notification Card should be completed noting each separate defendant and attached to the appropriate defendant’s Arrest Affidavit. 2. These separate cards will permit the notification of the victim upon the release of individual defendants. 3. Card distr ibution will remain the same.
