ORANGE COUNTY SHERIFF'S OFFICE SPECIAL ORDER Effective Date: September 2, 2020  Amends - SO 58.0 (April 28, 2017) Number: 58.0 Distribution: All Reserve Deputies Review Month: May Reviewing Authority: SOD / Specialized Patrol Subject: Reser ve Deputies This order consists of the following: 1. Purpose 2. Definitions 3. Procedures 1. Purpose The purpose of this policy is to establish guidelines and procedures to be followed by all members of the agency Reserve Deputy Program. 2. Definitions A. Direct Supervision (as it pertains to Auxiliary Deputies ) – The requirement that auxiliary deputies function while “under the direct supervision” or “in the company and under the direct control of a full or part -time law enforcement officer” is met as long as the auxiliary deputy is directly accountable to a full or part -time law enforcement officer who is in the immediate vicinity of the scene and who has ultimate control of the situation. The deputy providing direct supervision must be a full -time or Reserve deputy with the agency who has completed the Field Training and Evaluation Program (FTEP). Direct supervision could be accomplished by telecommunication technology provided ultimate control of the situation rests with a full -time or part -time fully certified law enforcement officer. (Attorney Generals’ Office Opinion AGO 93 -64, September 14, 1993). Direct supervision via telecommunication technology w ill only be used in exigent circumstances , or when movi ng an agency vehicle as per GO 9.1.1 ). B. Hours of Service – Volunteer hours provided by the Reserve Unit deputy that are used to satisfy Reserve Unit responsibilities as indicated in 4(D)(4). Hours of service will not include any detail where the Reserve Unit deputy receives monetary compensation for their work C. Auxiliary Deputy – a volunteer deputy , with limited auxiliary certific ation , who serves in accordance with applicable law, agency policy and has law enforcement authority only while under the direct supervision of a fully certified Orange County deputy sheriff, reserve deputy, or other law enforcement officer as determined b y the Sheriff or designee. D. Reserve Deputy – a volunteer deputy with full certification who serves in 58.0, Page 2 of 9 accordance with applicable law and agency policy. 3. Procedures A. Organization and Structure 1. The Reserve Unit is a component of the Special Operatio ns Division. The Reserve Unit will be composed of Reserve Deputy and Auxiliary Deputy personnel. 2. The Special Operations Division Commander or designee shall exercise direct control over organization , administration, and discipline of the Reserve Uni t. 3. The Special Operations Division Commander shall appoint one full - time sworn manager of the rank of Lieutenant or above as Unit Coordinator to act as liaison with the Reserve Unit and the agency. 4. The numerical strength of the Reserve Unit will be determined by the Sheriff. The organizational structure will be similar to that of the agency. Organizational structure will be adjusted to meet the needs of the agency and the Reserve Unit. 5. Command ranks will be determined and adjusted based on the needs of the unit. 6. The authority and responsibility of the respective reserve ranks will be commensurate with equivalent full -time deputy ranks, except that reserves do not have command authority over full -time deputies regardless of rank. 7. The Rese rve Unit Commander shall coordinate all operational and administrative responsibilities of the Reserve Unit. 8. The Reserve Unit Commander shall report to the Unit Coordinator. The Reserve Command staff, comprised of necessary command personnel, shall re port to the Reserve Unit Commander. B. Unit Coordinator Responsibilities The Unit Coordinator shall: 1. Disseminate on a timely basis all necessary information. 2. Assist the Reserve Unit Commander with all administrative matters including, but not limited to, discipline and training. 3. Authorize the issuance of uniforms and equipment and confirm that all equipment is returned when a member terminates. C. Applicants 58.0, Page 3 of 9 1. The selection requirements for Reserve Unit deputies are the same requirements as for a full -time deputy. 2. New Reserve Unit personnel shall be on probation for one (1) year or until completion of the FTEP, whichever is longer. Deputy Sheriffs retiring in good standing from the agency are not subject to the probationary period. 3. All Reserve Unit deputies must successfully complete the approved Field Training Evaluation Program administered by the agency FTEP Coordinator, which consists of the Deputy Orientation Program and Phase 1 of the Field Training Program. Reserve Unit Deputies must complete Phase 1 within 18 months of the last day of Deputy Orientation . The FTEP Coordinator or designee may, based on the Reserve Unit deputy’s previous training, experience and certification, waive all or part of the FTEP. Reserve Unit deputies in Phase I of the FTEP shall receive daily observation reports. Reserve deputies who complete Phase I of the FTEP within their first year, shall receive quarterly evaluations until their one year probationary status is completed. 4. Auxiliary deputies who hold or obtain a full law enforcement certificate, have completed the FTEP program, and wish to become a Reserve deputy may submit a memorandum via the chain of command to the Human Resources
