ORANGE COUNTY SHERIFF'S OFFICE GENERAL ORDER Effective Date: January 21, 2011  Amends - G.O. 19.1.0 (June 25, 2010) Number: 19.1.0 Distribution: All Personnel Review Month: January Reviewing Authority: HRD / Division Commander Subject: Cross Sworn Law Enforcement Officers This order consists of the following: 1. Purpose 2. Policy 3. Definitions 4. Procedures 1. Purpose The purpose of this directive is to define the limits of authority for cross sworn law enforcement officers. 2. Policy It is the policy of the Orange County Sheriff’s Office to aid other law enforcement agencies within the state of Florida, specifically Central Florida, in the carrying out of their duties and responsibilities to enforce the laws of the state of Florida and the constitution of the United States through the cross swearing of their certified law enforcement officers to act as deputy sheriffs within Orange County. 3. Definitions Cross Sworn - The act of giving sworn status within unincorporated Orange County t o certain sworn members of other federal, county and/or municipal law enforcement agencies for the purpose of permitting those officers to act as deputy sheriffs within Orange County. 4. Procedures Cross sworn personnel are authorized to exercise the same powers as the Sheriff of Orange County pursuant to FS Chapter 30 and enforce Florida State Statutes and the Constitution of the State of F lorida with the following limitations: A. To solely aid/assist the Sheriff of Orange County in the performance of his/her duties as elected Sheriff. B. Any actions taken by cross sworn officers are subject to the written directives of the Orange County Sheriff’ s Office. Copies of high liability written directives are provided to all cross sworn personnel. All other directives ar e available for review in Human Resources. C. Except in circumstances where immediate action is needed to prevent the loss of life or s ignificant damage or loss of property, cross sworn officers must notify and receive specific authority to act from either the Sheriff, Undersheriff, Watch 19.1.0, Page 2 of 2 Commander, or Sector Commander of the sector in which they intend to exercise powers as an Orange Cou nty Deputy Sheriff. D. Any arrests made in the name of the Sheriff of Orange County must be immediately reported to either the Sheriff, Undersheriff, Watch Commander, or appropriate Sector Commander. Orange County Sheriff’s Office forms will be utilized to document the incident. E. The seizure of any assets pursuant to FS Chapter 9 32 will be processed through the Orange County Sheriff’s forfeiture procedures. F. Under no circumstances will cross sworn officers exercise their powers as an Orange County Deputy Sheriff to initiate or further an investigation beyond authorization provide d by the Sheriff or appropriate Sheriff’s Office command personnel. G. Cross sworn officers shall not use their authority as an Orange County Deputy Sheriff to work off -duty employment or to accept reduced rent or rent free apartments. H. The provisions of Mut ual Aid will not be extended or combined with this authority to extend the power of cross sworn officers to other than what is approved under current mutual aid agreements or the “Deputization Limitation Form” signed by all cross sworn officers. I. Cross swo rn status and authority as an Orange County Deputy Sheriff will automatically end at the conclusion of each four year term of the Sheriff and must be renewed in order to be continued into the next four year term. The Sheriff of Orange County must receive written approval from the CEO of the agency prior to any member of that agency being cross sworn as an Orange County Deputy Sheriff. J. The Sheriff of Orange County reserves the right to revoke the cross sworn status of any law enforcement officer at any tim e, with or without cause. K. Orange County Sheriff’s Office personnel are to confirm cross sworn officers act within the guidelines of this directive and do not abuse the authority provided to them by being cross sworn. The Human Resources Division Commande r shall be notified of any violations or improper conduct of officers acting in a cross sworn capacity. L. Cross sworn officers whose status is revoked by the Sheriff or who no longer need to continue in this capacity shall immediately return all identificat ion to the Human Resources Division Commander .
