ORANGE COUNTY SHERIFF'S OFFICE GENERAL ORDER Effective Date: November 7, 2016  Amends - GO 4.2.3 (April 16, 2010) Number: 4.2.3 Distribution: All Personnel Review Month: October Reviewing Authority: HRD / Employee and Labor Relations Subject : Standard Work Hours for Deputies This order consists of the following: 1. Purpose 2. Policy 3. Definitions 4. Procedures 1. Purpose The purpose of this policy is to define standard work periods for deputies . 2. Policy It shall be the policy of the agency that deputies shall only work a maximum of six consecutive days and no more than eighteen consecutive hours. Deputies should have at least eight hours off prior to reporting to regular assigned duty unless approved by the employee’s supervisor . This policy may be waived during any disaster, special event, or major investigation, or with authorization from a Division Commander. 3. Definitions A. Actual Hours Worked – hours physically on the job. B. Basic Hours – include the total actual hours w orked and/or leave hours taken up to 80 hours. C. Deputies - Law Enforcement Deputies in the following positions: Deputy Court Security Deputy Deputy First Class Master Deputy Corporal Sergeant D. Standard Work Period - a consecutive fourteen ( 14) day p eriod. 4. Procedures A. Normal Work Sc hedule An eight (8), ten (10), or eleven and one -half (11½) hour daily shift, with days off and hourly schedules established by supervisors, totaling eighty (80) hours bi- 4.2.3, Page 2 of 3 weekly , in a standard work period , depending o n assignment. B. Meal Periods Deputies, with the exception of th ose assigned to Court Security , are not guaranteed a meal period during a tour of duty. If one is granted, it shall be used as expeditiously as possible to enable the deputy to return to ass igned duties. The deputy’s meal period shall not exceed thirty (30) minutes exclusive of travel time and shall be compensated as time worked for pay purposes. In assignments where deputies are provided a standard one (1) hour meal period, the meal period shall not be considered part of the workday and compensation shall not be provided. C. Rest Periods Rest periods s hall be counted as time worked for pay purposes. Although deputies are not guaranteed rest periods during their shifts, supervisors should make every effort to allow deputies two, fifteen (15) minute rest periods when working scheduled shifts. Rest periods will not be scheduled as the first or last fifteen (15) minutes of the work day. Rest periods shall not be scheduled to extend the duration of meal periods. D. All employees are required to report to work in accordance with their scheduled shift unless their absence or tardiness has been approved by their supervisor or chain of command. E. Recording Time Worked Work hours (time in, time ou t) will be recorded on a daily basis. These records reflect the actual hours / time worked. 1. If time is accumulated in a particular work period and adjusted (flexed) before the end of that same work period, it will be adjusted on a one for one basis. 2. Compensatory time or overtime shall be granted to all deputies who have worked, with supervisor approval, additional hours in excess of their basic hours in a standard work period. A deputy working overtime has the option of receiving payment or compen satory time, subject to applicable caps. a. Compensatory time or overtime shall be compensated at a rate of one hour for each additional hour worked not adjusted (flexed), which is in excess of eighty (80) actual hours worked , but less than eighty -two (82) actual hours worked in a standard work period . b. Compensatory time or overtime shall be compensated at the rate of one and one half hours for each additional hour of time worked not adjusted (flexed), which is in excess of eighty -two (82) actual hour s worked in a standard work period . 3. Agency employees issued vehicles are not compensated while driving to and from work since this time is not considered on -duty time worked unless a deputy is taking law enforcement action. F. Division Commanders may adjust work schedules for deputies, corporals, and sergeants. 4.2.3, Page 3 of 3 G. Administrative leave may be granted by the respective Division Commander to deputies, corporals, and sergeants attending agency approved training courses .
